Barbara Fiala, state chair of the Women’s Equality Party, a ballot-qualified party in New York, is a registered Democrat. This news story says she plans to remain a Democrat. The law will require the Women’s Equality Party to choose someone who is a member of the party by November 2015.

    Me; “He CAN’T be serious!!! Instant Runoff Voting implies single-winner districts and in multi-winner districts IRV and STV (STV=single transferable vote) are not needed and are a waste of time.

    Richard Winger is wrong.

  5. Approval Voting = No good.

    In approval voting the largest majority voting block regularly wins a super-majority.

    Approval voting and instant runoff voting (IRV) are winner-takes all. In IRV single winner districts, the largest civic group wins year after year and that is the mathematics which cement a two-party system. Because when one civic group wins year after year, the best alternative is the 2nd biggest civic group. So the winners alternate between one and maybe two civic groups under IRV.

    This guy is supposed to be a “leading authority” on election law? Those are his own words, but my word are that “Richard Winger doesn’t know jack.”

    Winger repeatedly writes that he favors PR. He reports on PR regularly on BAN.

    But politics is the art of the possible. While getting to PR can be a long-term goal, in the near-term, we should take the incremental steps we can to improve voter choice. His recent piece published at IVN lays out two reasonable reforms for California, where the norm, let’s remember, is the anti-choice Top Two system.

    If Richard, you, or I could wave a magic wand and implement PR, I suspect each of us would. But we don’t have those wands, so other measures are necessary.

    This doesn’t mean there isn’t reason or room for you to remind people of the benefits of PR. That’s why, in response to Casual Observer, Richard isn’t going to censor you. We can always use voices promoting PR. But the rants you have spewed above aren’t going to convince anyone of anything, and are, if anything, counterproductive.

  8. These comments by James Ogle have absolutely nothing to do with the news item on the NY Women’s Equality Party!
    I agree fully with the comment of Casual Observer. Richard, you should somehow block James Ogle from making comments on BAN articles. James Ogle should utilize his own blog (the fantasy parliament) to vent his opinions. He probably doesn’t because that blog of his more than probably does not get anywhere near the exposure that BAN does. James Ogle does not seem to appreciate the generosity of Richard Winger and BAN in continuing to permit his postings. Richard Winger has always (and I have followed BAN ever since it was “HR1592 News” in the early 1980’s) been objective and overly fair to all 3rd parties and to all independents. Richard did not make up the bit about being a foremost expert on ballot access issues – this has been acknowledged by virtually every 3rd party and by many courts. So, I guess he does know “jack”! Richard – please restrict James Ogle from all of these lengthy comments of his.

  10. I’ve known James Ogle for 20 years. I have been to his home when he lived in Butte County, and he has been to my home. He is always pleasant when we see each other in person, although we haven’t seen each other in person for several years. He has many good goals and ideals. Once he made a good effort to get homeless people to register to vote.

    Me; Yes, and top two works fine in California, because the minimum threshold is 33.33% (plus one vote), to win a runoff election under Top Two.

    Top Two is in effect a more sensible reform than IRV since IRV requires a 50% plus one vote) threshold, a much more difficult threshold which leads to a two-party system.

    IRV = bad reform.
    Top Two = good reform.

  14. How does one win a run-off with 33.33% (+1) of the vote? Do you mean, one needs that threshold to make it to a run-off?

  15. The top 2 scheme is one more distraction from ANTI-Democracy gerrymanders — related to the CA gerrymander commission that made the latest gerrymanders for the CA legislature and U.S.A. Reps.

    EVIL and VICIOUS ANTI-Democracy gerrymander math –
    1/2 or less votes x 1/2 rigged gerrymander districts = 1/4 or less CONTROL —

    in all 99 houses of all 50 State legislatures and the USA House of Reps.

    Much worse math in the semi-forever USA Senate — around 12 percent possible control due to the many small States.
    —-
    NO primaries.
    P.R. and nonpartisan App.V. — pending Condorcet head to head math — or even direct voting by ALL electors on bills, etc. in legislative bodies.

    Probably a mistake to give any credence to James Ogle, but I will defend IPR: We report on and repost releases from ALL alternative parties, even the crazy racist ones. The American Freedom Party runs candidates, including a presidential ticket in 2016, therefore we (or at least I) try to treat them equally. In fact I’ve had a good working relationship with the AFP, despite that I personally find their views abhorrent. Do not mistake posting an article with endorsing the message contained within.

  18. Top Two guarantees two winners with 33.33% (plus one vote) or less when more names are on the ballot.

    The threshold drops randomly depending on the number of candidates, a randomness that benefits third parties and independents.

    While IRV (instant runoff voting) requires a 50% (plus one vote) to win, no primary and exceptions.

    So the United Coalition like Top Two because of the lower threshold and the potential team spirit generated between the two top candidates. The team with the most spirit might have a better chance, it is all random of course.

    I like Top Two better than the way elections were before, and better than IRV, the only change I would make would be towards pure proportional representation (PR).
