Maine Libertarian Party Wins Injunctive Relief

On May 27, a U.S. District Court granted injunctive relief to the Maine Libertarian Party. The state must give the party credit for the 4,513 registered members it obtained last year. The law requires 5,000 registered members to be a qualified party. The party now has until July 12 to get another 487 registrants. If it does so, it will be a qualified party for purposes of the presidential election. This means the party will not need to do an independent petition to be on for President this year, assuming it does finish getting 487 more registered members. Also it means the party will be listed on voter registration cards.

If the party wants to stay officially registered after the 2016 election, it will need to either 1) win 5% for president 2) have at least 10,000 registered Libertarians vote in the November election or 3) sue the state to remove the obscure requirement regarding the number of voting members. I’m not a Libertarian but I am a third party member in Maine and I urge the LPME to prepare for door #3. Neither options 1 or 2 are likely. Even if they were, Maine’s ballot access requirements for small parties are horrendous and need to be drastically reformed.
