Two Voters Sue Colorado to Invalidate Law that Criminalizes Photographing One’s Own Voted Ballot

On October 24, two Colorado voters filed a federal lawsuit to overturn the state law that makes it illegal for any voter to photograph his or her voted ballot and show that to anyone else. Hill v Williams, U.S. District Court, 1:16cv-2627. Here is the Complaint. Similar laws in Indiana and New Hampshire have recently been struck down as a violation of the free speech portion of the First Amendment. Thanks to Rick Hasen for the link.

  1. What’s next — Show me/us your ballot or DIE — i.e. all sorts of bribes/threats —

    See the old time ROT before official primary ballots came along in 1888-1890 — robot party hack bosses watching and recording how folks voted.

  2. Contrary to the silly rant “Demo Rep” posted, the issue is the first amendment right to engage in political speech including showing people who you claim to have voted for. I say “who you claim to have voted for” since of course images can be altered so a ballot selfie doesn’t verify who you voted for anymore than a mere statement “I voted for X”. Therefore no one in their right mind would buy a vote based on a ballot selfie any more than they would based on a verbal claim “I voted for X, give me the cash”, when they might have voted for candidate Y instead. Vote buying is already illegal, even if they trusted a selfie as verification, are they really going to care if a ballot selfie they use as part of the exchange is also illegal? Is making that illegal really going to change anything?

    The law actually also states that you can’t talk about how you, or anyone else, voted. Someone threatening a voter to get them to vote how they wish won’t care about such a restriction. However someone whose vote was coerced may be scared of talking to others about the issue and not get the support they need to report it to the authorities. If it isn’t a level of coercion that is technically illegal, they may also be scared of getting help ignoring the coercion next time.

    The real danger of voter coercion and fraud in Colorado is due to mail ballots, not ballot selfies.

  3. How about making photo copies of WAR plans and WAR codes and WAR orders — for total exposure to everybody – esp. potential foreign ENEMIES — also some sort of 1st Amdt *right* ???

    ALL mail ballots now in Oregon and other areas — are such areas more or less corrupt than other areas having election day ballots ???

    i.e. this is all one more giant New Age ATTACK on the SECRET BALLOT — by the New Age EVIL DEVIL hacks from Hell — using the now standard politically correct response for ALL of their EVIL machinations.
