Don Blankenship Says West Virginia Constitution Party Has Nominated Him for U.S. Senate

This article says Don Blankenship has announced that he has obtained the U.S. Senate nomination of the Constitution Party of West Virginia.

The Constitution Party is not ballot-qualified in West Virginia, but the petition requirement for U.S. Senate for the nominees of unqualified parties is 4,537, due August 1, not terribly difficult. The number is 1% of the number of votes cast for U.S. Senate in West Virginia in 2014 (there was no U.S. Senate election in West Virginia in 2016). It is somewhat unclear whether he can be kept off the ballot because he had run earlier this year in the Republican primary.

  1. Deep State Blankenship has always been in this to re-elect Manchin. Now he makes that crystal clear.

  2. Reading the article, it is pretty obvious that Blankenship is anything but “deep state” given his attacks on “establishment” not to mention previous attacks on Manchin.

    §3-5-23. Certificate nominations; requirements and control; penalties.
    (a) Groups of citizens having no party organization may nominate candidates who are not already candidates in the primary election for public office otherwise than by conventions or primary elections. In that case, the candidate or candidates, jointly or severally, shall file a nomination certificate in accordance with the provisions of this section and the provisions of section twenty-four of this article.

  5. 6,602 signatures. Unfortunately the WVSOS misinterprets §3-5-23(c) for US and state senate contests to mean the last election for the same seat. “The number of signatures shall be equal to not less than one percent of the entire vote cast at the last preceding general election for any statewide, congressional or presidential candidate, …” which to me would indicate to use the 2014 US Senate election vote numbers (when Shelley Moore Capito ran for Rockefeller’s seat, no WV senate contest in 2016). But since this year’s contest is for Joe Manchin’s seat, they are using the 2012 numbers when he last ran (which are larger due to the presidential year):

  6. And just to clear things up, Don Blankenship HAS NOT BEEN formally “nominated” by the Constitution Party of WV. All that happened was that the state Executive Committee interviewed him on a conference call with the national party leadership, did some vetting relative to state and national platform positions, and explained to him how things worked, i.e., voter registration (he changed his immediately), waiting period (60 days), ballot access petitioning ins and outs, etc.

    In WVa, non ballot-qualified parties DO NOT nominate their candidates in the traditional sense (registered voters participating in a convention). CPWV candidates are ALL nominated by the candidate nomination petition form.     The candidate nomination comes from voters of a variety of affiliations. There are only 190 registered CP voters in the state, so a Don Blankenship 3rd party run would have to have the support of a cross-section of other voters.

    However, there are some upcoming meeting scheduled between Don’s well-funded campaign team and the small number of duly notified registered voters of the CPWV whereby a formal candidate endorsement will be sought. Stay tuned.
