Florida Democratic Party Lawsuit on Order of Candidates on Ballots Won’t Get a Decision Until After 2018

The Florida Democratic Party sued the Secretary of State earlier this year, over the law that says the party that won the last gubernatorial election will always have its nominees listed first on general election ballots. Jacobson v Detzner, n.d., 4:18v-262. On July 12, the U.S. District Court set forth some deadlines for the case. Discovery will not be complete until November 8, 2018, so it is obvious that the case won’t be settled until after this year’s election is over.

  1. DO ANY cases started between Nov election day of YEAR X have ANY REAL effect on the next election in YEAR X plus 1 or 2 or 3 or 4 or 5 or 6 ???

    Will SCOTUS ever order a NEW election —

    for mere UNCONSTITUTIONAL elections ???

  2. Oddly enough, Illinois actually has a better way of determining the order of parties on the ballot. A random drawing at each County Clerk’s office, with a representative of each party there to do the drawing and the County Clerk to certify it on the spot. I was the person to draw for the Green Party this year here in Jackson County (we’re Established in Jackson County and the whole 12th District).
