West Virginia Republican Party Asks Permission to Intervene in Constitution Party Ballot Access Lawsuit

The West Virginia Supreme Court is currently considering whether the Constitution Party’s candidate for U.S. Senate, Don Blankenship, should be on the November ballot or not. Blankenship v Warner, 18-0712. On August 17, the state’s Republican Party asked permission to intervene. This is somewhat surprising, because West Virginia has a Republican Secretary of State.   1. Nothing more than just a bunch of whine to go with Mac Warner’s baloney because obviously the State has no interest in the majority of their stated arguments:
    “(2) ensuring that the votes cast in the Republican primary are respected; (3) tempering the destabilizing effects of party splintering and excessive factionalism; (4) guarding against divisive intraparty fights after a political party has chosen its nominee; (5) preserving the overall stability of West Virginia’s [establishment] political system.”

    You really have to laugh (or cry?) at that last one.

    If the Republicans were so concerned about these issues, they should have thought twice before spending millions of their own resources attacking Mr. Blankenship. “Ditch Mitch” indeed!!

  6. Jeff, Richard, When did 3-5-23(g) pass? This is the “sore loser” law they reference in the case. Was this the one passed after this election season started?

  7. 3-5-23(g) is essentially irrelevant since all that it does is clarify the intent of the main text. The “sore loser” language was added to 3-5-23 in 2009 along with half a dozen other changes, most notably lowering the petitioning requirement from 2% back down to the original 1% from ten years earlier. Not only was it improperly done (see brief), but it blatantly conflicts with the previous section 3-5-22 which is for parties which nominate by convention instead of petition. The Mountain (Green) Party is running two candidates who lost their respective GOP and Democrat primaries, but you don’t see the Republicans complaining about David Tabb nor do we see the Democrats raising an issue with Susie Worley-Jenkins’ county commission candidacies. The Republicans are deathly afraid of Don Blankenship’s candidacy and are completely uninterested in equal application of the law.

  8. Sore loser laws deny voters the right to reconsider after they have evaluated the “selected” candidate’s performance after a primary election or other nomination. Legislators frequently reconsider a prior vote and make correcting amendments. Voters however are suppose to vote and stay locked-in no matter how irresponsible and incoherent the first choice candidate becomes.
    Sore loser laws are handcuffs on voters as is much of the rest of U. S. election laws.

  10. The United Coalition’s video featuring California Constitution Party chair and the 2nd Mid-Atlantic Super-state Parliament’s lone Constitution Party member, was evidence that the Constitution Party is working closely with the United Coalition USA.

    The Environmentalist Party’s success with uniting the Libertarian, Green, along with Anarchist, Boston Tea, Constitution, all parties and independents, has been a small success.

    We cannot take the credit, we owe it all to the team.
