Historian Michael L. Rosin Files Amicus in Washington State Presidential Elector Case

Historian Michael L. Rosin, who lives in New Jersey, has filed this amicus curiae brief in Guerra v Washington State, 95347-3.  Like the Independence Institute amicus mentioned in the preceding post, Rosin also argues that the intent of the U.S. Constitution is to give presidential electors freedom to vote for any qualified candidate for President and/or Vice President.

  1. Exactly. We vote for presidential electors, not the party nominee to which their slates are attached. Unfortunately, most states have election laws where this is completely turned upside down. For example, here in West Virginia, the state code actually prohibits the names of the electors from appearing on the ballot.

    Richard, How many states still list the PEs on the their ballots?

    Also, if we had single presidential elector districts, ballot access would be much easier because minor parties and independents could at least get on in smaller sections of the state where entire statewide access is prohibitive.

  2. Jeff Becker, single winner districts bring a two-party system, and that applies to large or small populated districts.

    Creating smaller single winner districts under plurality voting (yes/no or “X”) will bring a two-party system, and under RCV, approval, etc., will bring a one party system like SF, Oakland and Maine.

    President and Vice President will bring a three-party system, and the United Coalition USA guarantees that us men will bring the first female President or Vice President when we unite for this cause.

  3. States that still print the names of presidential elector candidates on the ballot are Arizona, Idaho, Oklahoma, and South Dakota. The Oklahoma law gives the State Board of Elections the authority to remove the names, but so far the Board hasn’t exercised its authority to do that.

    IE – VOTER's right to vote subverted if a Prez Elector does NOT vote for the Prez HACK involved in the Prez Elector's election/*appointment* — DIRECT/INDIRECT legal stuff.

    Did ANY State have any NONPARTISAN elections BY THE VOTERS of 12th Amdt Prez electors ???

    eg – elect wise statesperson folks to elect a USA Prez ???

  6. Before the Aussie ballots the party hacks had their own printed hack ballots

    — perhaps with NO Donkeys, Elephants, etc. critters — BUT many with colors.

    IE vote the color X ballot in public and get your bribe or get purged — led to secret ballots.

    Before government-printed ballots, voters could make their own ballot. Newspapers also printed ballots, though many newspapers were more overtly partisan, and even carried party names. Since there were no formal nominations, newspapers could use news judgment in deciding who to put on their ballots. Since newspapers owned the printing pressex, they would likely print the party ballots, as well as any other local printing.

    If we would go back to single-office elections, we could just give voters a sheet of paper, perhaps with the office and name written on it. If nobody received a majority, hold a new election in a month. At the end of election day, count the ballots and write the precinct results on a sheet of paper. No need for egistration since everyone knows their neighbors.
