North Carolina Board of Elections Orders New Election for U.S. House, 9th District

On February 21, the North Carolina Board of Elections called a new election for U.S. House, 9th district, because all sides agreed that the November 2018 election had been tainted by absentee voting fraud.  So far the Board’s web page does not have any information about the new election.  It will be interesting to see what the ballot access rules are for any independent candidates who might emerge.  Probably the petitioning period will be short.

  1. The legislature recently passed a law requiring a primary to be conducted if the NCSBOE election calls for a new congressional election.

    In the original election last November, the Libertarian may have been a spoiler. The losing candidate in the 2018 Democratic primary, who had been the party’s nominee in 2016, endorsed the Libertarian nominee, Jeff Scott, saying that nominee Dan McCready was “beholden to the corporate deep pockets in Nancy Pelosi’s Democratic political machine.”

    Under the old law, the re-run would have been with same candidates. Presumably all five qualified party’s would be able to make nominations.

    In the hearing, Marc Elias was the lawyer for the Democrat candidate. Elias was the attorney for the Montana Democratic Party in their in their lawsuit keeping the Green Party off the ballot in Montana. The Montana Supreme Court has ruled that Elias should not have been allowed to appear pro hac vice before the lower court.
