Eleventh Circuit is Taking Unusual Amount of Time to Decide Lawsuit Filed by 2016 Bernie Sanders Supporters

The Eleventh Circuit held oral argument in Wilding v Democratic National Committee Services Corp., 17-14194, on December 11, 2018. There is still no decision. It is somewhat unusual for courts to take this much time to issue an opinion, after the oral argument, at least in election law cases.

Wilding v DNC is the case filed by individuals who had contributed to the national Democratic Party in 2015 and 2016, and who supported Bernie Sanders for the 2016 nomination. They sued because they felt the Democratic National Committee had tilted the 2016 nomination contest against Sanders and for Hillary Clinton. The U.S. District Court had ruled against the Sanders supporters.

  1. ANY surviving parts of 1800-1801 MD common law in Deceit City – when DC *officially* started [and had MD laws on various law subjects — NOT replaced by USA/DC laws ] ???

    — IE group/association top persons unequal treatment of group/association members —

  2. It seems like the court wants to avoid interfering in the internal politics of a political party. I don’t blame them. The implications could reach far beyond this case and set a precedent for resolving intra-party disputes in court. Be careful what you wish for.

  3. Same last resort court stuff in internal disputes in religion groups.

    IE Parties should have internal judicial bodies / *courts* in their consts/bylaws.

  4. As it is, we have 2 major parties that control the political process. If they are allowed to continue collude with the media and big moneyed interests to rig primaries, our democracy is doomed. The courts simply have to step up with the right ruling.

  5. Thank you for the update! Since I’m not a legal expert, kindly help me to understand what this means. Seems the Libertarian Party is petitioning (for a finding?) And the Federal Election folks are asking the Supreme court for a month to respond? Is this case on the way to the Supreme Court?

  6. This is inexcusable since this was heard last December. The first decision said to work it out at the ballot box. I believe they are delaying due to the elections and fraud is exactly why it was in court in the first place. If corporations do have the right to choose their candidate, then say so & save us time, anguish and money. This is ridiculous. Thanks for the update. At least we know we did not miss it. I am wondering if there is a time frame that is imposed on a decision delivery.

  7. If a crime has been committed it should not be excused due to fear of meddling in the internal workings of the DNC! What kind of logic permits a crime to go unpunished due to the inner workings of a party?

  8. Representative democracy depends on fair and legal elections. If they can not be assured, all laws will be the fruit of a rotten tree. All of American Justice and governance depends on a clear and just ruling. We must preserve the Constitution against all enemies, foreign and DOMESTIC.

I’m sorry, but this issue is right up there with Catholic priests being allowed to continue their evil deeds for no telling how long, with protection from the church……..and also very similar to our police situation in our country, where all of our police departments and sheriffs’ depts. have been permitted to “police” themselves since forever, therefore, letting themselves off from every despicable crime they commit!!!! Is this really what we want our country to be about??? When are THE PEOPLE going to DEMAND to be the ones to elect their representatives instead THE PARTIES???
