Libertarian Fails to Get on Ballot for Alabama Special Legislative Election

The Libertarian Party petition for ballot access in the upcoming special election for State House, 42nd district, has been rejected. The party was initially told it was 19 signatures short. It found 30 signatures that it believed had been erroneously rejected. The state accepted six signatures. It said evidence about the remaining signatures was submitted too late. See this story.

All of this will be evidence in the pending lawsuit over whether the state must give a free list of the registered voters to unqualified parties that are petitioning. That case is now undergoing discovery.

  1. The SOTS informed the LP on August 29th that the signatures were invalid. The LP then showed evidence that they were valid. And the SOTS replied that the LP should have provided the evidence of the SOTS’s mistake by August 20th. Unbelievable.

  2. Aug 20 – turned in
    Aug 28 – their reply
Aug 29 – Frank Dillman made a trip to pick up copies
Sep 3 – We raised enough money for a new list and discovered it did not have DOBs just ages
Sep 5 – They provided us with a list with DOBs
Sep 16 – They claim we should have replied to their reply, which they did not give us until Aug 28, by Aug 20

  3. We actually paid for the list twice, over $300 each time. Once initially to nationbuilder for the map (plus 35.00/month maintenance fee) and once for the latest info from SOS. Plus there was a $82 charge for photocopies of 82 pages with the SOS notations of what they thought was or was not valid.

  4. This race remains very winnable even as a write in.

Less than 4,000 people voted in the primary. There are close to 32k registered voters. In a district which is about 80% Republican the primary is the “real election.” The vast majority of the district is Chilton County usually Republican voters. But three Chilton County Republicans put together could not force a runoff. That’s because the vast majority of the district is unhappy with their local politicians and saw no reason to turn out to vote.

They have even less reason to vote in November. The Democrat is essentially a paper candidate. The Republican is from the sliver of the district which is in another county. No one thinks the Democrat has any chance. Turnout will probably be half or less of the barely double digit percentage who came out on Aug 20 for the primary.

It may take a thousand voters to win this race. That’s a number that we can activate to come out and write in with an active door to door, business to business and person to person campaign along with rides to the polls.

  5. I wonder if it would be possible to get a statement from the R and D candidates condemning the SOTS’s behavior. They might feel safe doing it, now that Ward is off the ballot. They might think he is no longer really a candidate. You could then use the R and D statements supporting Ward while promoting his write in campaign.

  6. Back in 2008, a Libertarian in Pennsylvania ran for state legislature, but due to some gross ismanagement issues with the petition drive from LP National, this candisate failed to get enough signatures to get on the ballot. This did nit deter him, as he still ran an aggressive campaign as a write in candidate. He spent around $28,000, some fundraised, but most out of his own pocket. He printed up professional looking signs, and campaign literature, and he, and maybe 2 or 3 campaign volunteers, knocked on every door in the district. They handed out campaign literature to every home, plus they gave out blank voter registration forms to every home where people were not registered to vote. I think they ran some local ads as well. He running against a Republucan and a Democrat, and he ended up getting 17% of the vote as a write in candidate. Just imagine how many more votes he would have gotten had he actually qualified for the ballot.

  7. In this case the same strategy should yield a lot more than 17% if I understand the data above correctly assuming it is accurate.

Agreed, and it’s accurate. See my comment in the thread above

  9. Interesting that the comment from “Ed Ng,” posted at 4:29 PM on 9/20/19, is something that former LP petitioner Gary Fincher had on a bumper sticker on the back of his car years ago. The only other poster here that would know this besides me, is Paul Frankel. So it looks like “Ed Ng” is Paul Frankel.

Now the question is since when did Paul develop an affinity for the Council on Foreign Relations (see the tread about Earl Ravenal)?

  10. “Andy fixes his tin foil hat while furiously connecting pictures with red yarn on a board”

LOL, yep. Andy thinks I remember what was on some bumper sticker on Gary’s car from years ago? Really? Honestly I do not even remember Gary ever having bumper stickers on his car, much less what was on them.

He must also think that this is the only place this phrase appeared. Yes, Gary had this bumper sticker made for him and only him. And no one else ever saw it besides Andy and me.

As for the Council on Foreign Relations I have no affinity for them. Unlike Ed Ng, I am happy with the results of the 1983 LP convention.

  11. Paul – if the Republican doesn’t help, then tie him to the corruption of the SOTS and make that the issue of the campaign.

  12. ROFLHOCHIMINH

It should come as no surprise that is what passes for logic in the mind of Alex Jones, David Icke, Stefan Molyneux, Hans Hoppe acolyte Andy Jacobs, the addled bircher/lizard conspiracy nut job. Show me on the doll where the Council on Foreign Relations hurt you Andy. In reality aside from Bircher fantasies they are a wonderful organization that fosters international cooperation between the forces of freedom and democracy against the tyrants, kleptocrats, dictators and medieval monarchs of the world – you know, the ones your idols want to make the only game in town on the global scale. No wonder you and they hate the CFR so much. What you really hate is the enlightenment, which you want to snuff out.
