California Governor Signs Bill Letting Voters Change Party at the Polls on Primary Day

On February 13, California Governor Gavin Newsom signed SB 207, which takes effect immediately. It lets voters change their party on election day, or at any time during the two weeks before a primary or an election. They already had the ability to change if the change was made earlier than that.

  1. The National Popular Vote Plan doesn’t bypass the electoral college. There is nothing in the US Constitution that tells states how to choose electors. Among the original states (i.e., the 13 colonies who won the independence war), all but two of them at least once had their state legislature choose the electors, instead of using a popular vote. As late as 1876, the Colorado legislature chose all the electors instead of the people. In 1892 Michigan had each US House district choose its own elector. In 2000 one house of the Florida legislature passed a bill in December to let the legislature choose the electors.

  7. I first met Demo Rep at a national meeting about alternative voting systems in the early 1990’s. He has for years sent me news items that I use. He donates to COFOE. He is very well-informed about many arcane election law matters. You may not realize how many posts I have thanked him for, because I have traditionally thanked him using his real name.

  14. SB 207 was a bill dealing with asthma. The House stripped out all the original language and stuffed most of a bill that Governor Newsom had vetoed last year. They sent it back to the Senate to concur in the amendments.

    The way the Libertarian, Democratic, and American Independent primaries work, is that NPP AND other (non-qualified) registrants may request their ballot.

    A Republican could change to the Trump Party and request a Democratic ballot.

    If the Common Sense Party was up to their game, they would be encouraging voters to change to Common Sense before they voted in the Democratic primary.

  17. Does this law matter for anything else besides the presidential primary? I thought that under Top Two, any California voter could vote for any candidate in the (non-presidential) primary anyway. If not, how does Top Two work?

  18. This law also matters for voting for party central committee members. Only party members can vote on that office.

  21. A few comments:

    (1) This is really the only site I know of for this type of information, and a lot of it is critical knowledge. Professionals working in ballot access have told me they rely on BAN.

    (2) A lot of the information wouldn’t pop up on Google search unless you already knew what to look forand where. It’s pretty clear Mr. Winger relies on the kind of people who do things like show up at court hearings, follow meeting agendas and minutes, or at a minimum see things on obscure local news sources and forward to him.

    (3) Therefore we ought to give maximum gratitude and maximum slack to both him and the people he relies on.

    (4) And of course all that’s on top of the fact that it’s his site and he can do what he wants.
