California Elections Code 13205 says, in part, “Additional instructions to voters shall appear on the ballot…In elections when electors of President and Vice President of the United States are to be chosen, there shall be placed upon the ballot an instruction as follows: ‘To vote for all of the electors of a party, stamp a cross in the square opposite the names of the presidential and vice-presidential candidates of that party. A cross stamped in the square opposite the name of a party and its presidential and vice presidential candidate is a vote for all the electors of that party, but no other candidates.'”

Leaders of the American Independent Party have noticed that 53 of the 58 counties did not include this instruction on the November 3, 2020 ballot. The only counties that did include the language are Alpine, Inyo, Kern, Nevada, and Santa Barbara.

My own sample ballot, from San Francisco, merely says, “Federal”. Below that is “President and Vice President.” Below that, “Vote for One Party”. Below that are the names of candidates for president and vice president, with a party label. The words “presidential electors” do not appear. I checked my collection of ballots and it appears the last time a San Francisco County ballot included the words “presidential electors” was the 1972 ballot. Thus, the problem seems to be an old one.

Most states have laws that require general election ballots in presidential years to explain that the voters are really voting for elector candidates.

  2. Maine-Nebraska style single presidential elector districts and go back to printing the names of the actual electors on the ballots. This will make it easier for independent and minor party candidates to secure ballot access. You should obviously be supporting and promoting this idea, Richard.

  3. While choosing district electors in itself might be a good idea, I don’t see how that would improve ballot access.

  4. Walter, because in difficult states like Oklahoma, California, etc., a party would at least be able to successfully petition in a few districts and at least get a shot at SOME electoral votes instead of none at all.

  9. Even in the two states that apportion presidential votes by congressional district, Maine and Nebraska, there is no petition to place a presidential ticket on the ballot by congressional district.

    Hardly anyone would take a presidential ticket seriously that was only on the ballot in one, or a few, congressional districts in a state, in states that have more than one US House district.

  11. @ Andy – The idea would be that folks could run as their own presidential elector. Instead of petitioning the party onto the statewide ballot and then requiring the candidate to list his/her slate of presidential electors, the electors themselves would petition onto the ballot, be listed by name (and optionally with a national nominee) on the ballot, and then campaign in their respective districts for their national candidate. They could campaign as a Trump supporter flying Trump flags, or as a Biden supporter wearing their Rona mask and standing in a little circle, etc.

  15. Presidential Electors questions I’ve had rolling around in my head. Maybe Richard Winger can answer them.

    1. Shouldn’t None of the Above in Nevada have electors assigned to it? That way you can vote for electors that at the Electoral College can cast ballots for “none of the candidates” that were on the ballot.
    2. Or why can’t there be an “Uncommitted” option on the ballot. Some state parties in primaries or caucuses have Uncommitted as an option. This would be like the Unpledged Electors option a couple Southern states had in the ’50s and ’60s.

Currently as of one hour ago, the number of ballots in California that did not comply with CA Election Code 13205(b) as amended by AB 623 effective 1 January 2020 stands at 17,322,719 if one overlooks the write-in and the over and under vote. This means that only 563,758 ballots in California based on CA Elections Code 13200 should be cast and counted. That means that nearly 97% of the ballots in California are flawed and should note be legally cast or counted.

  28. No Circle Targets on any Los Angeles County Ballot. 5.6 million ballots were issued by the Los Angeles County ROV Dean Logan. The instructions on all of the ballots to vote are to “fill in the circle to the left of your choice”.

    Note the are no circles to the left on any candidates on the LA County 5.6 million ballots. There are only ovals targets. An oval is not circle. Also the instruction listed in AB 623 as CA Elections Code 13205(b) and 13205(c) do
    not appear on any of these LA Count flawed 5.6 million ballots. Even though AB 623 became effective on 1 January 2020.

  35. In Los Angeles County within Pre. # 9001999A in Woodland Hills which Trump call out as 2000 votes, but
    in fact was 2102 flawed ballot, only 20 voted on the first ballot mailing and the second ballot mailing was the second set of flawed LA County Ballots.

    As for the HAVA Type Ballots in Los Angeles County
    the total of that vote which did not require the instructions in 13205(b) was 25,212 votes. Therefore the good ballots in Los Angeles County out of 5.6 million ballots would be
    25,232 good ballots.
