U.S. Supreme Court Has Had Montana Republican Party Request for Relief from Open Primary for Five Days Now

On March 11, the Montana Republican Party asked the U.S. Supreme Court to allow it to escape the June 7, 2016 open primary. The Court has had the request for five days now and still has not acted. The case is Ravalli County Republican Committee v McCulloch, 15A911. The request was filed with Justice Kennedy, who handles emergency matters for states in the Ninth Circuit.
