  1. You misread the story. Bob Krist is seeking to run for governor as the Democratic candidate for governor. He had earlier toyed with the idea of running as an independent or of a new party.

    Nebraska statute permits a political party to impose a rule requiring candidates to be registered with the party. If a party imposes or revokes that rule they must do so before December 1 before the primary. The Democratic Party apparently has such a rule. If a party has such a rule, candidates must be affiliated with the party before December 1. The Democrats could have revoked their rule, or Krist could have registered with the party before December 1.

    The complaint against Krist is by a Democratic candidate for governor who was a Democrat before December 1, 2017.

    The law does not apply to candidates of new parties or small parties. There is another statute that applies to independent candidates that requires disaffiliation before March 1.
