New York State Elections Board Squeezes Nominees of SAM Party and Libertarian Party Into the Same Ballot Row

Here is the November 2018 sample ballot for New York state upstate counties. Even though this is a paper ballot, which could easily list all the gubernatorial candidates in a single column, this ballot puts the SAM Party nominee for Governor and the Libertarian nominee for Governor in the same row. Every other party has its own row.

The SAM Party has no candidates for any office except Governor/Lieutenant Governor, but the Libertarian Party has candidates for two other statewide offices, Attorney General and Comptroller.

  1. I could understand this if New York were still using the old machines. They only have a certain limited number of rows, so the state often had to combine parties onto the same line.

    But notice this paper ballot has a blank row between the SAM/Libertarian row and the write-in line. The Libertarians and the Save America Movement could each have been given their own lines. And that would enable them to spell out “Save America Movement” instead of having to use SAM.

    I wonder if Cuomo’s pet Secretary of State wanted to make sure nobody noticed SAM, sinc Stephanie Minor is a Democrat.

    BTW, this ballot is going to have to be reprinted. it still lists Nixon/Williams.

  2. To stay on the ballot for future election without another petition drive, the LP in NY needs 50,000 votes for Governor. They came very close last time. So the pols decided to screw with them. Same old same old.

    — ie made a percentage of the total votes (as is done in most *modern* States).

    The minor parties will never allow it, and they’re the tail that wags the dog.

  8. When New York replaced the iron behemoths they had a design competition. They kept adding details such that all but two companies dropped out of the bidding. The old machines were manufactured in Jamestown so there is a requirement that parts be made there. They also had to maintain the experience of the old machines so that the number of rows remained the same even though scanners can easily be adapted to permit more rows. In the State of Con-Fusion the NYCBOE machines have columns for each party rather than rows. IIRC, the number of rows and columns are not the same.

    The Libertarian and SAM parties are technically independent candidates with a label. There may also be independent candidates for other offices, who would be placed on the last row.

  9. 1. As someone pointed out, there is an open spot above the write-in. Why didn’t they just put one of the parties in that spot?

    2. If they insisted on leaving that spot blank, maybe they could have combined 2 of the 30 ballot lines that Cuomo appears on.

  10. Michigan, they can’t combine the lines. The party order on enrollment forms and ballots for the next four years is determined by order of finish in the gubernatorial race.

    As for the 50,000 vote benchmark, I”m glad that number has remained constant. It’s a difficult test. I see no reason to apply a percentage requirement or to increase the number with population growth. If 50,000 people will vote for a party that party should have four years to run candidates. It’s a great way for the state to allow political groups with different ideas to be tested. New York State in a sense does the rest of the country a favor by being a place where groups can achieve party status. They can exist even if they can’t win. It’s a good thing.

  11. The New York definition of “qualified party” is faulty. It is impossible for any group to become a qualified party in a presidential election year. New York and Indiana are the only two states with that flaw. When New York first wrote its definition of “party” in the 19th century, it elected its governor every two years. But starting in 1940, there were no gubernatorial elections in presidential years.

  12. Over the centuries, New York State went from electing the governor every 2 years, to every three years, and then to every 4 years.

  17. Kentucky is sort of the opposite of New York and Indiana. Whereas New York and Indiana make it impossible for a group to become qualified in a presidential year, Kentucky makes it impossible to do that in a midterm year.
