California Senate Passes Bill Making it More Difficult to get on a Presidential Primary Ballot

On April 25, the California Senate unanimously passed SB 505.  It makes it more difficult for a candidate to get on a presidential primary ballot.  Current law lets the Secretary of State decide whom to place, but he must place any candidate who is “generally recognized.”

The bill says candidates must satisfy two of these criteria:

(1) qualified to receive primary season matching fund

(2) has participated in a debate hosted by a political party that is qualified to participate in a primary election

(3) on the presidential primary or caucus ballot of another state

(4) the party wants the candidate on the ballot, and he or she must have a campaign office in the state.

    1) I assume that this bill does not in any way affect the ability of parties to count any & all write-in votes in the Presidential primary of any party. 2) Will there be a mechanism for a candidate to indicate disapproval of being listed on the Presidential primary of a qualified party? 3) Does the proposed debate requirement require it to be held somewhere in California? 4) Hasn’t the ability for a candidate to qualify for matching funds been made harder since 2016, AND with the primary now being held in early March, WHAT relief would a candidate have available to their being listed on the ballot IF they qualify for primary season matching funds after the State started printing up the primary ballots? Enough for now?

  3. Write-ins would still be allowed in the California presidential primaries. No candidate will be placed on a California presidential primary unless he or she applies to be on. The law does not say the debate must be held in California. The requirements for primary season matching funds have not changed recently, although HR 1 passed the US House and it does make it far more difficult; but that bill has no chance in the US Senate.

  4. So option 2 says “has participated in a debate hosted by a political party that is qualified to participate in a primary election” It doesn’t specify that it has to be the same party the person is running under. So a DEM candidate could participate in an open debate put on by the green party and would still satisfy that requirement.
