Kanye West Files Ballot Access Lawsuit in Wisconsin — 2 Comments

    It will be interesting to see how this shakes out. The lawsuit includes item 16 which asserts that “It is undisputed that the nominating papers complied with Wisconsin’s regulations…” …Wisc Elec Law 2.05(1)&(2).

    Subdivision (2) is going to be relevant as it reads in part “(2) In order to be timely filed, all nomination papers shall be in the physical possession of the filing officer by the statutory deadline. Each of the nomination papers shall be numbered, before they are filed…”

    Seems likely to me that defendants counsel will argue that item 16 is, in fact, disputed. Much will be made of the specific wording about whether by entering the doors of building at 5:00:14 the papers were at that time “in the physical possession of the filing officer.” In particular, the two filing officers present give their testimony at approximate 1hr48min in the hearing that after arriving at the office several minutes were spent by the West team organizing and properly numbering the pages of the papers. If they continued to add numbers for “several minutes” then the papers were not at that time in “physical possession” of the filing officer.

    Still, it seems to me that there’s lots of reasons that this could go either way. In particular, the lack of official recording timeclock. Having chosen to accept the papers without notation that they were late, plaintiffs will certainly have a strong presumption of timeliness.

    To me it’s a coinflip and how one stands on the issue will depend upon where they sit.
