Ruth Bader Ginsburg Dies

On September 18, U.S. Supreme Court Justice Ruth Bader Ginsburg died.

No member of the current court was more favorable to minor party and independent candidates and voters than she was. She wrote Buckley v American Constitutional Law Foundation, which struck down state laws requiring petitioners to be registered voters.

Also, in the last Supreme Court decision that discussed minor parties, Clingman v Beaver (2005), she joined the dissent of Justice John Paul Stevens which said, “There is over a century of experience demonstrating that the two major parties are fully capable of maintaining their own positions of dominance in the political marketplace without any special assistance from the state governments they dominate.”

  1. I didn’t always agree with her decisions but she was one tough lady. You don’t have to agree with someone to respect them. RIP Justice Ginsburg.

  2. Trump has made remarks in recent interviews that he thinks he’s “pretty libertarian” and that if Gary Johnson hadn’t run he would have won the popular vote. Both are untrue but if he thinks that he might try to nominate a relatively libertarian justice to curry favor with more Libertarian voters. One can dream…

  4. This election was already screwed, now it’s going to be an absolute sh*tshow (I would never self-edit like this, but I don’t know Richard’s cursing policy). Honestly, 2016 had nothing on this election year. Can anyone think of a good comparison for this one?

  6. If I seem bitter it is because I am.
    One of my first political experiences was an unjust conviction in US District Court for Eastern PA.
    My attempts at remedy, with an excellent case, failed.
    18 USC Section 2255, Federal Rules of Criminal Procedure 32(d), withdrawal of guilty plea.
    So now I look forward to adversarial proceedings against a US Attorney in adversarial proceedings in US District Court for Western PA.
    If there is justice to be had in US District Court, I should win.
    If not I will lose, again.
    We shall see, shant we?

  7. Interesting update on my health.
    I went to Urgent Care today.
    I was hoping to get a stronger antifungal. I had hit my right foot with a long, heavy daily dose but it did not seem to be getting much better very fast.
    Turns out the athletes foot had allowed a bacterial skin infection in.
    I was throwing the wrong medicine at the problem, antifungal instead of anti bacterial.
    Meanwhile my left foot had cleared up! Along with other areas of skin blemishes most notably on my arms.
    As you know, the skin is one organ. So hitting one area, my right foot, with large doses of medicine, spread it to all of my skin in time.
    I learned a good lesson!

    A centrist among the liberals on the Court is about right. -LOL!
    The Court is loaded with ultraconservatives,
    making a liberal look radical left!

  9. RGB should have retired before Obama finished off his Presidency. Perhaps every Associate Justice should retire after they reach age 80 during the administration of the President that they support and before 80 If they are not in good health. The next eldest is Stephen Breyer who is 82. He better hope that Biden wins otherwise he will be 86 by January 2025.

    Up to recently the powers that be figured Trump will win.
    But now they hedge their bets.
    So just in case, they “die” RBG so DJT can get to appoint another Supreme Court justice.
    RBG gets to go to Israel to finish her life there.
    So, RBG cancer death fake. Funeral, burial fake.
    Note: if Biden wins, RBG most likely to die on his watch, giving the replacement pick to him.

  12. IMO, the Electoral College is a good idea — for judges.

    We ought to consider choosing judicial electors every 2 years who would go to DC and fill any vacancies in the federal courts.
