On July 20, Larry Elder filed a lawsuit in Superior Court in Sacramento to get on the September 14 recall gubernatorial ballot. He had been excluded because he didn’t redact his Social Security number from his tax returns. Apparently this was an inadvertent error. His lawsuit argues that the Secretary of State had the authority to redact the number; alternatively, his failure to redact the number harms no one except himself. The California Supreme Court said in 1978 that substantial compliance is good enough. The Court put the incumbent Superintendent of Public Instruction, Wilson Riles, on the ballot, even though he didn’t file one piece of paperwork that was required. Riles v Eu.

Larry has some valid points in his appeal. At first, I thought he was a cry baby. Not now. Newsome’s corrupt bunch seems to be cleverly targeting any candidate that could be better than he is (which is everyone on the ballot). Larry filed 300 pages of tax forms? Geez! He has a point when he emphasizes they should have explained to him the certain aggrieved error and give him time to correct it (was it a missing tax page? a signature missing?) Would I vote for Larry? No! But I back him trying to correct his possible railroad job.

The statute requires a candidate to prepare two copies. One without redactions and one with. If the candidate redacts too much, the SOS simply prepares a corrected version and publishes that.
