California Recall Proponents File Lawsuit to Censor Gavin Newsom’s Ballot Statement

On July 30, supporters of the California gubernatorial recall filed a lawsuit to censor Governor Gavin Newsom’s statements in the Voters Handbook. Heatlie v Weber, Sacramento Superior Court. Here is the Petition for Mandate. Governor Newsom’s statement says, in part, “Vote No on the recall of Democratic Governor Gavin Newsom to stop the Republican takeover of our state.”

The lawsuit proponents want to eliminate the word “Democratic” in Newsom’s statement. The lawsuit also claims that some of the other sentences in Newsom’s statement are “false or misleading”. For example, his statement says, “The recall is an attempt by national Republicans and Trump supporters to force an election and grab power in California.”

I’d have to agree with the recall proponents on at least some of their claims, particularly the bit about Newsom’s statement that the recall being an attempt by Republicans and Trump to force an election and grab power being misleading. It’s misleading because there were almost certainly minor party members and Independents who signed the initial petition, and there are minor party and Independent candidates on the ballot, who almost certainly do not support the Republicans or Trump. It’s borderline libelous.

  3. Apparently, Newsome’s actions confirms where California’s problems stem from. Perhaps, Elders can win and clean it up. However, I still go with the thought that a moderate Dem is the only thing that can beat Newsome.

  4. I think it is unfair if he can’t say he’s a member of the Democratic Party in his statement in the voter booklet, but the part saying that Donald Trump and the Republican Party nationally had anything to do with this recall, or that they are the only ones who want Newsom out, is misleading.

    I hope the Governor wins this lawsuit and that it might set a helpful precedent that it is also unconstitutional or unlawful to prevent all candidates from having a party label, such as the candidates in this election of the Socialist Workers Party, the American Solidarity Party, and the California National Party.

  6. Debra Bowen, Alex Padilla, and Shirley Weber should be prosecuted for vote suppression in denying candidates the right to have their party preference as expressed on their affidavit of voter registration appear on the ballot.

  8. Trump and National Republicans are who is really behind this expensive and unnecessary recall. Waste of time and money. Newsome is doing a great job and they should leave him alone. Vote to retain.

  10. Mr Winger is wrong in seeing a precedent if Gov Newsom were to win the case
    on identifying himself as a Democrat. He, as a member of a qualified party,
    already has a right to identify himself as a Democrat on the ballot, as he has
    done in the past running for state-wide office.

    Newsom’s loss so far is a statement in favor of equal treatment before the law,
    since others who miss paperwork deadlines suffer legal consequences. And if he were
    granted special treatment in this case, it still would not provide a precedent applicable
    to a candidate affiliated with a non-qualified party.

  11. You missed past stories here. He is not being given the opportunity to identify himself as a Democrat on the ballot line. I’d have to check back but iirc some kind of paperwork screw up and the courts refused to make an exception.

Oh Richard Winger… when you don’t have the facts straight you make silly uneducated comments… Not only did Newsom fail to meet the deadline to declare his political party designation, but the bill that implemented that deadline was one that Newsom himself signed into law in 2019, and one that was unanimously supported by Democrats. He has changed enough rules in the middle of the game… time to give him the boot! Lord Newsom your reign is coming to an end!!
