On March 16, a new lawsuit was filed in Solano County, California, state court, over the identity of the proper officers of the American Independent Party of California. The case is King v Robinson, fcs033119. This is yet another round over the disputed state conventions of the AIP in 2008. Previous lawsuits filed by the faction of the party that is allied with the national Constitution Party never reached a resolution on the merits, because of procedural flaws in the filings.

A presidential candidate needs some 160k signautures in a fairly short time framse.
The cost of such would run well over $1 million.
So when is the hearing?
It’s way too early for anyone to know a hearing date. This is not a case that is being expedited.
If people were really supporting the CP party and not just registering as an Independent getting those people to sign up should be pretty straight forward or they could also register on the libertarian ticket as a way to fully support the constitution. The libertarians are a fully qualified party under there own name, right.
I was the elected chairman of the convention of AIP
in 2008. The convention took place at the Sacramento auditorium of the California Secretary of State. Jim King did not attend the convention,
but Don Grundmann did attend the convention and addressed the convention from the floor before he
departed the American Independent Party 2008 state

real issue with the party was the fact that his wife was removed from the national committee by the
state central committee, because she was registered

Jim King term expired as a National Committeeman on
September 3, 2008. He is still a member of the State Central Committee, but holds no office in the
party. Don Grundmann is a member of the State Central Committee, but he too held no office in the
AIP since his term expired as a National Committeeman on September 3, 2008. The American Independent Party is not connected to the Constitution Party.

The AIP never disaffiliated from the Constitution Party. Mark Robinson, Mark Seidenberg, Ed Noonan, and Gerald and Grace Hill deliberately conspired to commit fraud by filing false documents with the Secretary of State office to claim that the AIP disaffiliated from the CP. No vote for such a disaffiliation ever took place. The above 5 liars will shortly be investigated and prosecuted for fraud and conspiracy to commit fraud via their deliberate filing of false documents with the SOS office in order to deceive that office. The AIP is still affilated with the Constitution Party.
A fortunate result of the 2008 campaign is that Alan Keyes is exposed as a corrupt liar and complete fraud. to the vote, I spoke with several high officials with the CP to find out if we crossed all T’s
and doted all the I’s. We followed the California Election Code and the by laws of the AIP to the
letter. We check with a lawyer and with the officials of the California Secretary of State.
I recall talking even to Gary Odom, about Grace
Hills request if CP would return to her part of
fees she paid to the CP. The answer from Gary Odom
was no, which I passed on to Mrs. Hill.

telephone meeting, but an online meeting. People
did use telephones to talk with each other, but all
votes were taken on line. We were following the
rules established at the Secremento meeting that

Committee for being registered as Republican in Los

I for one would like that law amended so the
State Central Committee could pick a location

From the Superior Court Clerk in Fairfield, CA in case #FCS033119 a complaint for declaratory and injuntive relief between James King (Plaintiff) and
Markham Robinson (Defendant), I received a copy of
documents filed in the case.
In the complaint on page 2, lines 26 – 27 it makes
reference to an affidavit of James King as verified facts. However his attorney failed to lodge with the complaint a copy of that affidavit,
if in fact a copy ever existed in the first place.
My guess using a Brewtown lawyer was one of many
problem Mr. King will be faced with in this lawsuit. Another problem with the events in Los
Angeles was that Conventions of the American Independent Party must be in Sacramento. Los
Angeles is not a part of Sacramento. The California Election Code sections 7608(b) and 7620 require the conventions of the American Independent Party to be in Sacramento. However, on July 5, 2008, the California Secretary of State provided her Auditorium at the Sacramento Secretary of State Building for the American Independent Party to use for a convention.
I was elected chairman of the convention by the delegates to the 2008 AIP Convention. Dr. Don Grundmann showed up and spoke from the floor at the convention in his normal way, attacking the delegates for not voting the way he wanted. This type of speech from Dr. Grundmann was heard before, viz., at the CP convention in Kansas City in April 2008.
Further, at the Kansas City CP Convention I was the proxy holder of James King who directed me to cast his vote for Ambassador Dr. Alan Keyes for President.
The bottom line the only Convention in 2008 of the
American Independent Party took place in Sacramento, CA on July 5, 2008 in the Auditorium
of the California Secretary of State Building.

One document filed in this case was an “AFFIDAVIT OF PERSONEL SERVICE” Form # 65 Rev.7/02. It is dated 3-16-09 and signed by a purported Deputy Clerk of the Court [Superior Court of California,
County of Solano, with the address box checked to

Just read a purported “Declaration of Ann Thomas” that was submitted by a Brewtown lawyer of James
King in KING v. ROBINSON. I have real concern that
Ann E. Thomas is the author of this declaration for
the following reason. At # 9 it states in part Noonan also replaced Larry Brazeale and Rayna King
with Merton Short and Elliot (sic.) Grahm (sic.).
I know of no one in the American Independent Party
named Elliot Grahm. The State Central Committee voted to fill the empty seat that was held by Rayna
Mike King (who was registered in Los Angeles County
as a Republic) it was not done by then Chairman Ed
Noonan, The AIP State Central Committee elected long time party activist Elliott S. Graham. Ann E.
Thomas knows how to spell Mr. Graham’s name correctly.
The other reason I question that this was not done
by Ann E. Thomas was that at # 1 it states that “I
have personal knowledge of the facts asserted herein, and if called upon to testify to said facts, could do so competently.” I recall that
she walked out of the 2007 AIP State Central meeting that replaced the open spots of officers
of the AIP (American Independent Party). Therefore
I question that this was authored by Ann E. Thomas,
because I do not believe Ann E. Thomas would state
that Ed Noonan was the source of the appontments,
when it was AIP State Central Committee that made the appointments.

First I will correct spelling error in last posting. The word should have been spelled “Judases”.
Second, both Don Grundmann and James King voted for
Ed Noonan for Chairman at the September 3, 2006 organizational meeting in Sacramento (County) of
the American Independent Party. The term for Mr.

I guess we are having a private conversation right now. So when Dr. Don Grundmann. who had no one on
the Californio delegation (other than himself) to cast a vote for him as a endorsement to become the
President of the United States in Kansas City Convention of the Constitution Party, he was just
calling Markham Robinson a “Judas”, because he was
using “Weasel” for Seidenberg and “Satan” for Alan Keyes. Therefore, Dr. Grundmann yelling “Judases”
and “30 pieces of silver” in front of the California delegation after the first pole that I
conducted with Charles Deemer, Grundmann was just

First thing one need to know is the Convention of
the American Independent Party is a meeting of the
Delegates to the Convention and not a meeting of the State Central Committee. When Don Grundmann
undersigned a “petition for a call to convention
to be held on Saturday, June 28, 2008, at Los Angeles, CA, with a State Central Committee meeting to follow on June 29, 2008”, James King,
only petitioned for a call to convention and did
not petition for a meeting of the State Central
Committee. Therefore, Jim King did not petition
for a meeting of the State Central Committee on
June 29, 2008. Therefore, there was no majority
of the “party’s elected officers including the National Committee members” calling a meeting
of the State Central Committee for June 29, 2008
or any other date.
The organizational meeting for 2008 of the AIP State Central Committee took place in the Auditorum of the California Secretary of State Building in Sacramento, California on July 6, 2008, with Chairman Ed Noonan calling it to order. Markham Robinson was elected for a term
of two year follow the term of Chairman Ed Noonan
two year term.
Therefore James King and Don Grundmann are not officers of the American Independent Party.

Response : Mark – I told you that you are a Judas and got your 30 pieces at Sacramento, not Kansas City. So this is yet another complete lie. You KNOW, like with so many other things you state, that it is a lie. WHY do you continuously lie? To inflate your ego? To cover up your corruption and your crimes? Dr. Don Grundmann first yelled to the California Delegation at the Kansas City Convention of the
Constituion Party in April, 2008 the following:
“Judases” & “30 pieces of silver” after he could
not pick up even one other supporter (other than
himself at the first straw pole) conducted by
Charles Deemer and myself. Grundmann next repeats
this form of speech at Sacramento, California
on July 5, 2008 at the Convention of the American
Independent Party.
Next Don Grundmann and James King are not officer
of the American Independent Party and have not served as National Committeemen since September 2, 2008. They are only members of the AIP state central committee.
I am informed that the Secretary of the AIP, Ann E.
Thomas who lives at the home of the late William
Shearer in Lemon Grove, CA, was the source of the so-called “PETITION FOR CALL TO CONVENTION & STATE
CENTRAL COMMITTEE MEETING”. It should be noted here that Ann E. Thomas was the elected secretary
in 2006 for a two year term. She has never been a
member of the State Central Committee. Therefore,
she had no authority to call to order a meeting of
the State Central Committee. Likewise, Ann E. Thomas was not a delegate to the 2006 or 2008 Convention of the American Independent Party, so
she also had no authority to call that body to order either.
Next, the California Election Code at sections 7608(b) and 7620 with the bylaws of the AIP allow for
the convention and organizational meeting of the
state central committee only in Sacramento. Further while Dr. Don Grundmann signed a “petition”
with Ann E. Thomas address of 8158 Palm Street, Lemon Grove, CA 91945 at the top for “a call to
convention to be held on Saturday, June 28, 2008
at Los Angeles, CA, with a State Central Committee
meeting to follow on June 29, 2008”. That so-called “petition” was not sent to then State Chairman Ed Noonan or myself as the Vice Chairman
of the American Independent Party. That is why
the events in Los Angeles of June 28 & 29, 2008 is
known by the party officers as the “Cabal Events”.
When I ask as the Vice Chairman of Ann E. Thomas for copies of that bogus “petition” she told me that “I am not going to give you a G-d dam thing”.
From the exhibits filed by James King’s Brewtown
lawyer, only eight persons signed that bogus “petition”, viz., Ann Thomas as Secretary (who was a non-member officer of the state central
committee); Warren Campbell as Chaplain; Don Grundmann as a National Committee member; Charles
Deemer as the Treasurer & Nat. Comm; Tabatha Saavedra as Organizational Liaison; Al Huey as
National Committee member; Merton Short as National
Committee member; & an entry for someone named Elliott Grahm (sic.) with a signature that looks like that of Elliott S. Graham (if he did in fact
sign that bogus so called “petition”.
Cody, you should note that there were 21 offices in
the AIP. So eight (or nine by counting Mr. Deemer twice) does not make a majority. Does Don Grundmann know that eleven is the majority of 21?

Sorry for the brake in this e-mail.
Now Jim King on May 18, 2008 does his own bogus
“Petition For Call To Convention” with no one else
signing same. He does not call for a meeting of the
State Central Committee nor does he send a copy to
me as the Vice Chairman of the party. I am informed he did not even send a copy to Chairman
Noonan. However, Jim King as a former Chairman of
the party knew the Convention had to be held in
Sacramento. Just because Jim King wants to hold
a convention a week earlier than the July 5, 2008,
the state central committee could not have done so.
Because we could not get the Auditorium of the California Secretary of State Building the prior
weekend. The AIP does not revolve around Jim King.
I for one was in Dublin, Ireland working to Stop the ratification of the Treaty of Lisbon and protect the sovereignty of the nations of Europe.
In addition to being Vice Chairman of the AIP, I
am also the Vice Chairman of State Department Watch, Ltd. a foreign policy watchdog organization.
Prior to my work on stopping the Treaty of Lisbon,
I was in Greenland to cover the John Negroponte’s
delegation for Secretary of State Rice to the
summit on Law of the Sea as it effects the Arctic.
Even Charles Deemer helped me with this project,
by coming up with a great statement, viz., “DEEP SIX LOST TO DAVY JONES LOCKER”.
Just because Ann E. Thomas calls to order two events in Los Angeles in some hotel near the
Los Angeles Airport does not give the cabal
the right to hijack the American Independent Party.
Botton line both Don Grundmann and Jim King hold
no office in the AIP.

Party, But his candidate info says he is running under AIP? This guy can’t have it both ways.

Grundmann that the American Independent Party is
a branch of the Constitution Party and that a convention of the American Independent Party took
place in Los Angeles on Thursday, June 26, 2008
and Friday, June 27, 2008. Yet, on June 27, 2008,
at a meeting of the state central committee of the
American Independent Party we passed a resolution
affilating with the America’s Independent Party of
Fenton, Michigan. The following day James King at
a Los Angeles hotel throws a wad of paper in my face and yells at me. I opened the wad and noticed it was one of the 33,000 notices of that affliation with the America’s Independent Party issued by AIP party chairman Ed Noonan. Also on,
June 28, 2008 and June 29, 2008, Ann E. Thomas a
non-delegate, but non-member Secretary of the AIP
State Central Committee calls to “order” a bugus
cabal and claimed that it was a “convention”.
The 2008 American Independent Party Convention was
conducted on July 5, 2008 at the California Secretary of State Building within its auditorum. At that convention Ambassador Dr. Alan Keyes was
selected to run for President and Dr. Wiley Drake
was selected for Vice President.
It is a requirement of California Election Codes
7608(b) and 7620 that both the AIP convention and
organizational state central committee meeting be
in Sacramento.
Last year, James King filed a lawsuit against Chairman Ed Noonan, the State Printer, & California Secretary of State, claiming that the
State Central Meeting on September 3, 2006 was void
because it was conducted in Rancho Cordova and not
in the city limits of Sacramento. Rancho Cordova
is located in the county limits of Sacramento County. Subsection 7608(b) just states the State
Central Committee must be in Sacramento it does not state either if Sacramento is ment by city or
county. The court ruled that Sacramento would include the county under California Election Code
subsection 7608(b).
Since, Mr. Lussenheide, is the California State
Contact for the Constitution Party, does the CP
plan to qualify as a recognized political party
in California for the 2010 election?
