Alabama Ballot Access Case Will Move Quickly

On February 17, U.S. District Court Judge William K. Watkins held a status conference in Stein v Chapman, the Alabama ballot access case. The plaintiffs have asked for injunctive relief against the March 6 petition deadline for minor party petitions. To move the case along quickly, the plaintiffs will file their brief by February 24, along with evidence. If the Secretary of State feels that the evidence is insufficient, and that depositions are needed, she will say so by March 2. If there is a dispute about whether depositions are needed, the court will be notified by March 9. In any event, the state’s brief is due March 26. Plaintiffs may rebut no later than April 9, and the Judge hopes to rule sometime during April.

  1. As usual – are there ANY alleged disputed FACTS in ANY of the various ballot access cases ???

    Separate is still NOT equal.

Brown v. Bd of Ed 1954

  2. I am happy to see this case move along. I also trust Richard will not mind me using this post to bring all Alabama Independents and Alabama 3rd partisans (and others interested in electoral fairness) up to date on Alabama SB 15.

While I still personally prefer SB 55 (the filing fee bill) I realize that SB 15 has the best chance this session. SB 15 passed out of the Senate Elections committee and is now in the Senate Rules Committee. We must convince the members of the Senate Rules Committee to put SB 15 on what is called a “special orders” or at least vote to place SB 15 on the Senate Calendar and bring it up for debate in the Senate and hopefully a vote.

The Senate Rules Committee will meet again, Tuesday, February 21st. Everyone who wants to help this bill needs to either email or telephone the members of this committee and very politely ask him or her to place SB 15 on the Senate Calendar. The following is the email address of these members with a phone number listed below for those who do not have email.

MEMBERS OF THE SENATE RULES COMMITTEE

    Jabo Waggoner jabo.waggoner@alsenate.gov , Chairperson;

Jimmy Holley, Vice Chairperson; (phone numbers given below)

Scott Beason (phone number is given below)

Roger Bedford senbedford@aol.com , (Senate Minority Leader)

    Ben Brooks, benbrooksiii@aol.com

Gerald Dial, (phone numbers posted below)

Priscilla Dunn, (phone numbers posted below)

    Vivian Figures, vivian.figures@alsenate.gov
    Fax: (251) 208-5492

Rusty Glover, (phone numbers given below)

    Tammy Irons, tammy@ironslawfirm.com

Arthur Orr; senator at arthurorr.com (website)

    Senator Arthur Orr (website)

    Tripp Pittman, trip.pittman@alsenate.gov

    Paul Sanford.paul.sanford@alsenate.gov

It is also been suggested that copies of all emails to these Senators should be sent to the Rules Committee Secretary – Ms Andi Silberman. He email address is andi.silberman@alsenate.gov It is my understanding she makes sure these senators are aware of their email or attempts to contact them on behalf of legislation. So even if a senator does not have an email address, send an email addressed to him or her in care of Ms. Silberman. I understand she gives such email messages to them.

Those senators who have not posted their email address are listed below with phone numbers.

    Jimmy Holley (home) 334) 897-5181 (office) (334) 897-5181

    Scott Beason (office) (334) 242-7794

    Gerald Dial (home) (256) 396-5626 (office) (256) 396-5600

    Priscilla Dunn (home) (205) 426-3795 (office) (334) 242-7793 (fax) (334) 353-9625

    Rusty Glover ( home) (251) 649-7380 (office) (334) 242-7886 (fax) (334) 353-3970

Bottom line, contact those senators and plead for their support of SB 15. Again, as I’ve explained in previous emails, if the legislators do not see public support for a bill, they will not be motivated to support it.

  4. A big thank you to Senator Ward for his request. Keep the emails and phone calls coming. GA citizens defeated a ballot petitioning bill with 5 people in attendance. Anyone ready to travel to Montgomery next week?

“Have a request for it to be put on the special order calendar next week.”

    Respectfully,

    Cam Ward
