On September 11, the Michigan Libertarian Party filed a new lawsuit involving presidential ballot access. The new lawsuit is Gelineau v Ruth Johnson, and is filed in U.S. District Court in the western district of Michigan. The new lawsuit includes the Michigan Libertarian Party, and some of its presidential elector candidates, and also Gary E. Johnson of Austin, Texas. Here is the 14-page brief, plus the accompanying exhibits, including a declaration by Gary E. Johnson of Texas.
The new lawsuit challenges the refusal of Ruth Johnson to respect the wishes of the state party, that if she won’t print Gary Johnson of New Mexico on the ballot, that she instead print Gary E. Johnson of Texas on the ballot. She had refused to do that in a letter dated September 7.
In the meantime, the first lawsuit, to get Gary Johnson of New Mexico on the ballot, in pending in the Sixth Circuit.
The next two weeks will be make or break for the Johnson campaign, largely due to the fact states have to start printing absentee ballots thus requiring courts to expedite these cases.
Then again I could be wrong and off my rocker and these cases might drag on and on.
Well…47 states and DC so far. I hold out hope for PA and the longer OK is quiet to more optimistic I am. That being said, I think GJ will obtain the largest number of votes ever for a Libertarian Presidential candidate (by far), maybe get party status in several states and focus the public (a bit) on the two party stranglehold. A win – win in my book.
This is absurd and taking people’s votes away from them, taking is under statement more like STRIPING people from they’re rights to vote..Gary Johnson has every right and CONSTITUTIONAL right to be on that ballot , what these state officials are doing is taking the RIGHT TO VOTE away from the people…This has to stop this is America where we have the right to choose who to vote for , we are not 3rd war country where the gov picks are chooses, this is our freedom to express what we want and no MAN nor GOV should take that individual right to choose away…I really pray that inhumanly morals will change in this election and this decision!!
What kind of chance does this have? At least MI has Virgil Goode on that ballot as a possible alternative for GJ supporters. Here in PA (or OK) there aren’t any options if he fails.
The real key to the Johnson campaign is if they can hit 5% of the national vote total, which would unlock about $100 million in FEC funding. I expect Alaska and possibly New Mexico to see totals near or over 10% for Johnson, but most states will likely have totals in the low single digits so it will be exciting to see his voting returns as they become available to see if they add up to the 5%
The news that Texas has fielded so many candidates gives me hope for their vote totals.
Gee – Have LP folks learned NOTHING from the Nader stunt stuff in 2000 and 2004 ???
Which MONSTER is more EVIL from a libertarian viewpoint – the incumbent Obama communist [bankrupt the U.S.A. via deficits] MONSTER or the wannabee Romney fascist MONSTER ???
i.e. lots of LP folks will NOT vote for Johnson in the marginal gerrymander E.C. States but will vote for LP lower office candidates — as in all elections since 1972.
