On May 30, the Sixth Circuit asked the Michigan Secretary of State to respond to the Libertarian Party’s request for a rehearing, in Libertarian Party of Michigan v Ruth Johnson. This shows that the court is somewhat interested in the party’s petition for rehearing. The issue is whether the Michigan sore loser law applies to presidential primaries.
Obviously sore loser law doesn’t apply to presidential primaries, if it did the legacy parties wouldn’t be able to run anybody for president in all 50 states because one person hardly ever wins in all 50 states. For example in Pennsylvania Clinton won the primary but Obama was on the ballot in 2008. If sore loser applied they wouldn’t have been able to do that.
