Hawaii Democratic Party Files Reply Brief in Open Primary Case

On September 23, the Hawaii Democratic Party filed this reply brief in Democratic Party of Hawaii v Nago, the lawsuit in which the Democratic Party is hoping to limit participation in its primary to members of the party. The brief was in response to the state’s brief, filed September 16.

  1. Hawaii should let each party appoint a Party Control Officer (PCO). When a voter presents themselves, the PCO’s would either indicate thumb’s up (da) or thumb’s down (nyet). If a PCO indicated nyet, then the election clerk would stamp “Permission Denied” across the party selection box for that party.

    The voter would then be given the ballot in which he would be free to choose a party.
