U.S. Supreme Court Won’t Hear Ralph Nader’s Case Against Federal Election Commission

On December 2, the U.S. Supreme Court revealed it will not hear Nader v Federal Election Commission, 13-556. The issue was whether Nader had standing to sue the FEC for its failure to enforce campaign finance laws. Specifically, the Democratic National Committee and its allies did not report their expenses in attempting to keep Nader off the ballot in 2004 in two dozen states, and the FEC did virtually nothing to enforce the law. The U.S. Court of Appeals ruled Nader doesn’t even have standing to sue the FEC.

This is the last chapter in the many lawsuits filed around Nader’s 2004 ballot access legal fights.

  1. What is the reason given by the U. S. Court of Appeals 32644428that Ralph Nader did not have standing to sue the FEC?

The US Court of Appeals said even if Nader could sue the FEC, he hasn’t said he will run for president in the future, and therefore if Nader won, there is nothing concrete anyone could do to help Nader. Of course, if the FEC hadn’t stalled Nader’s complaint for years and years, that would not have been true, because Nader did run in 2008. So the lesson is that if the FEC stalls long enough, it is safe from being sued.

  4. Another act of corruption to add to the list of corrupt government policies and practices that’ll take a mass protest or electoral revolution to fix. But what will it take to wake people up sufficiently enough to do so? Too many voters are just content to play partisan football (the Democrats and Republicans) every two years.

  7. This is most unfortunate. After dealing with corrupt Chicago politics for over a decade I’ve come to terms with the fact that our judicial system is flawed. I do foresee a national movement rising which will result in shifting our Government back to the individual voter. Thank you Ralph Nader for fighting the good fight!

  8. If Ralph Nader doesn’t have standing in this case, then who would have. Would we as voting citizens have standing? What if it was the Democratic or Republican party bringing such action, would they have standing? If not, then no one would ever have standing to sue the Federal Elections Commission. So they’re a federal (that’s U.S.A.) government agency that can do what they want. No one has control over them, ah, except maybe their masters are the Republicans and the Democrats. That’s a conflict of interest and a disservice to the people of the U.S.A. Shame!
