Florida Democratic Party Sues to Extend Voter Registration Deadline

On Sunday, October 9, the Florida Democratic Party sued the state government to extend the October 11 deadline for individuals to register to vote. Florida Democratic Party v Scott, n.d., 4:16cv-626. Here is the Complaint. The lawsuit argues that the deadline should be extended because so many Florida residents in the past week had to leave their home areas, to avoid the tropical storm. The case is assigned to U.S. District Court Judge Mark Walker, an Obama appointee. Thanks to Rick Hasen for the link.

Florida Democratic Party Sues to Extend Voter Registration Deadline — 6 Comments

  1. How many of the marginal FL voters in the 2000 Bush v. Gore mess are still around — if not dead or in jail ???

Are the communist Donkeys on the march or what — to PERMANENTLY take over the U.S.A. ???

  2. Didn’t the Supreme Court rule in Bush vs. Gore that you can’t change election rules in the middle of an election, which is what the Florida Supreme Court tried to do?

Perhaps Florida Governor Rick Scott is trying not to repeat the same mistake.

Since the ruling affects all parties the same, and everyone knew when both the deadline and the hurricane was coming, why is this necessary other than being a political stunt?

  3. Had a similar problem in 2008 in Louisiana, when Hurricane shut down SoS and prevented Libertarian Party from certifying its candidate. SoS made up new rules and we argued that it violated Article II, which says only the Legislature can do that.

  4. Bush v Gore, 531 US 98, said, “Having once granted the right to vote on equal terms, the state may not, by later arbitrary and disparate treatment, value one person’s vote over that of another.”

Also, “the idea that one group can be granted greater voting strength than another is hostile to the one man, one vote basis of our representative government.”

Those are great principles. Unfortunately the decision also says, “Our consideration is limited to the present circumstances, for the problem of equal protection in election processes generally presents many complexities.”

  5. The only *complexity* is that each SCOTUS person is a robot party HACK not able to understand the *equal* in 14th Amdt, Sec. 1.
