Last year, the Libertarian Party won a court case against the Connecticut ban on out-of-state circulators. However, this year’s bill to amend the law to reflect current policy, HB 7163, failed to make any headway. It is now too late for the bill to pass this year.
Does the court’s opinion still control absent legislative action, Richard, or was it written so as to “sunset” at a date fixed?
The Connecticut law has been held unconstitutional, and the state didn’t appeal, so it can’t be enforced, regardless of whether the legislature cleans up the election law or not. But it isn’t fair to groups that don’t know about the court decision, to fail to update the election code.
