Ninth Circuit Tentatively Sets March for Hearing in Case Challenging Number of Signatures for Independent Presidential Candidates

On November 29, the Ninth Circuit asked the attorneys in De La Fuente v Padilla if they are available to participate in oral argument at all times during March 2019. This is the case that challenges the California independent petition requirement for presidential candidates. Current law requires 196,964 valid signatures, to be collected in 105 days. No one has complied with the California law since 1992.

  3. California should use Top 2 for presidential electors, with one elector from each congressional district and one from pairs of SBOE districts. An elector candidate could express their presidential preference or that they are uncommitted.

    A full slate of electors would require 55 x 40 signatures, or 2200 signatures. This is quite reasonable for a state like California, given that it has an implicit distribution requirement. It also recognizes the diversity of political views in California. The US Constitution would not have required 55 individuals to be appointed as electors, and individually ballot for President, if it was anticipated that they would be “faithful” automatons.

    Election of individual electors by district was the reform favored by Alexander Hamilton after the 1800 election, just prior to his being killed by Vice President Burr.

    The Top 2 primary could be held in September, which would permit political parties to choose their nominees at their national conventions. Top 2 would reduce the risk of spoiler candidates like Gary Johnson, Jill Stein, or even Bernie Sanders or John Kasich. It would also permit Rocky De la Fuente to put his name forward.
