New York Assemblymember Who Was Removed from the Democratic Primary Will Sue and Will Also Petition as an Independent

According to this story, New York Assemblywoman Rebecca Seawright, who was removed from the 2020 Democratic primary ballot over a paperwork error, will run as an independent this year if she can’t get back on the Democratic primary ballot.  She will also bring a lawsuit.

  1. It’s too late for her to run as a Libertarian. The Libertarian Party is ballot-qualified and in New York all ballot-qualified parties nominate by primary.

    No one is on the ballot for her seat at this moment except for the Republican.

    She also flubbed up her Working Families designation form. There is a Republican running. The district on the Upper East Side is 60% D, 22% blank, 15% R, 3% Independence.

    A quirk of NY election law is that designating petitions requires signatures based on party registration. A Libertarian would require 5 signatures, a Workin Families 3.

    Another quirk is that New York always permits write-in, but doesn’t put uncontested primaries on the ballot, unless there is an Opportunity To Ballot petition.

    Since there are zero Democratic and Working Families candidates they won’t have a primary and won’t have a nominee.

    Seawright’t website is under reconstruction, perhaps removing the Donkey pictures.
