Wisconsin Elections Commission Removes Howie Hawkins and Kanye West from Ballot

On August 20, the Wisconsin Election Commission removed Howie Hawkins and Kanye West from the November ballot. Hawkins’ petition was rejected because some of the signatures were collected on forms giving the old address of the vice-presidential nominee, and some on forms giving her new address. Kanye West was rejected because his petition was submitted past 5:00 pm on the filing deadline.

Hawkins will sue. In 2004 the Wisconsin Supreme Court put Ralph Nader on the ballot even though he did not have a presidential elector candidate in every U.S. House district. The Wisconsin Supreme Court said that requirement is “directory” in nature, meaning if the elector residency requirement is not met, that is not fatal to the petition. The vote was 3-3. All the Democratic Party representatives on the Commission voted against Hawkins; all the Republicans voted for him.

  2. I agree its a trivial reason to remove him but how does the previous case apply? “Submitting a list of electors” doesn’t to be the same or even close to “having petitions with conflicting information”

  3. https://heavy.com/news/2020/08/kanye-west-wisconsin-ballot/ In a link provided by a previous Ballot Access story says that the building was locked and by the time the building was opened it was 5:01 pm. This is alarming because they are denying ballot access on a technicality. A similar situation several years ago happened when a third party petition was denied because of a missed deadline because the office was closed because of a hurricane. Regardless of whether you support Kanye West this is the wrong action and the state should be sued.

  4. Mr. Apash, West’s application was filled with obviously fraudulent signatures (Bernie Sanders’, for instance). This was likely the Commission letting West down easy rather than open his “campaign” up to investigation for fraud. The fact that he’s now had applications rejected by at least six states strongly indicates that dishonesty is his “campaign’s” hallmark, and if he sues he will regret it.

    The Star Tribune has a more complete story about how Kanye’s ballot submissions proceeded. At 4:57 the West campaign rep called to say they were 3 minutes away. At 5:00:14 commission staffer was waiting at the door and admitted West’s rep. They then rode on the elevator together until at least 5:00:50. At 5:01:xx the West rep placed the papers on the counter but the papers were not properly organized. At 5 o’clock + several minutes, commission staffer actually accepted the papers.

    This seems like a no brainer. At 5:00:00 the building could have properly been legally closed as outside of business hours. Even if it took several seconds for the commission staffer to turn the key, it is clear that was not the difference in time for the papers to be presented as valid. Moreover, a delay entering the door is really no different than a delay waiting for an elevator to arrive at level. It is incumbent upon campaigns to make timely submissions. The fact that the papers were not actually accepted until several minutes after the deadline seals the deal. The commission already has multiple precedents of rejecting submissions that were submitted minutes past the deadline.

    Not a controversial decision, hence the 5-1 vote. Even the single GOP vote to accept did not deny the papers were late but instead argued that theses are unprecedented times.

  6. Were they at the door before 5 PM or after 5 PM? If they were at the door before 5 PM he should be on the ballot.

  7. YouTube, CNN and at least 2 other media sources have the video. The car pulls up at 4:57 (which is presumably when she called). She did not exit the car for several minutes. When she arrived at the door it was 5:00:14. The door was already unlocked by that time and she was unimpeded and not delayed in any way by the door being opened. Staff demonstrated that the elevator ride could not happen in less than 40 seconds, so she arrived at the office after 5:01. Simply factually late.
