Pennsylvania Supreme Court Removes Howie Hawkins from Pennsylvania Ballot — 40 Comments

  1. From the docket:

“In sum, the Commonwealth Court erred in dismissing Objectors’ petition to set aside Scroggin’s nomination, and Hawkins’ substitution, as the Green Party’s candidate for President of the United States. Scroggin failed to comply with he Election Code’s strict mandate that she append an original affidavit to her nomination paper, and the party’s use of Hawkins’ affidavit while presenting a nomination paper in which he was not “named therein” did not suffice to cure that error. That defect was fatal to Scroggin’s nomination and, therefore, to Hawkins’ substitution. Accordingly, the Secretary of the Commonwealth is directed to remove Howie Hawkins and Angela Walker from the general election ballot as the Green Party’s nominees for President and Vice President. The stay entered by this Court on September 14, 2020, is hereby lifted.”

  2. EQUAL still in 14-1 Amdt.

Must start 2024 ballot access cases immediately after 2020 results are final-final-final.

  3. Sad. So at this point is Jorgensen the only option on the ballot in PA other than Trump and Biden?

  4. Damn it. I’m so tired of this bull. I knew it would be a bad year for ballot access anyway, but I didn’t take into account Democrats screwing democracy at every corner.

  5. “…but I didn’t take into account Democrats screwing democracy at ever corner.”

Unfortunately, that’s what they’re best at. From Earl Browder in 1940 to Eugene McCarthy in 1976 to Ralph Nader in 2004 — and others in non-presidential races too numerous to mention — the Democrats have plenty of experience limiting our choices.

  6. Not happy with the decision but shame on the Greens for screwing up a rather straightforward part of the petition process. I realize this is their first time doing statewide substitution but know and understand how to do it!!

  7. This is a bad court ruling, but for the most part, the Greens have nobody but themselves to blame for not making it on the ballot in Pennsylvania, and a bunch of other states this year. Their 2016 candidate, Jill Stein, made it in the ballot in 44 states plus DC, but it looks like Hawkins is only going to be on the ballot in 31 or 32 states, plus DC. That is a big drop, but it was completely avoidable.

  8. A-N-Y GOOOOOD Green ballot access lawyers for 2021-2024 ???

Able to detect EQUAL in 14-1 Amdt — and make CORRECT court arguments ???

  9. A complete Tammany Hall travesty. The hypocritical rot & muck in the Democratic Party is far worse then we imagined. They want the state ballots in their favor no matter what. This is one of the worst anti-minor party injustices in American political history, ever.

To everyone here that opposes the twin evil system -no matter what your ideology or preferred minor party/independent candidate is this year; the MOST effective and powerful way to retaliate against the Jackass Party is-

    DO… NOT… VOTE… DEMOCRAT!

Sure, do not vote GOP either, yet the Democratic Party is the bigger offender and the greater evil here, and one that has its tentacles everywhere in our media and cable news networks- DO NOT GIVE ANY DEMOCRATS ON YOUR BALLOT YOUR VOTE! Even if it’s nonpartisan offices.

The Democrats need to BADLY be punished this year at the ballot box; they have been playing the fascist bully in this election for far too long, and too well.

  10. CQ –

    bit more

*progressive* election reforms killed off by 1917-1918 WW I Donkeys and 1933-1940 Great Depression I Donkeys.

2020 ROT = more of Donkey same — now with obvious RED Donkey commies trying to get TOTAL POWER.

  11. Hawkins won the primary nomination in June 2020, one month after Libertarians chose Jorgensen as their candidate. Unlike the Libertarians, it was a two man race and almost from the get go back in 2019 one could clearly see for a while that it was a done deal for Howie to be the nominee. He may have as well as gotten the nomination back then instead of going through this faux suspense.

For the next elections all third party candidates should clinch the nomination a few months earlier like in March. That’s neither too early or too late. The primary process should also be transparent and fair to all candidates which was definitely not the case for the Greens. The Green Parties in many European countries are far more organized then the Greens in the US. They are also less socialist. Let’s face it, the Green Party in 2020 seems to be mord à far left version instead of center left one that it is found in a lot of European nations. Probably one reason why at the end Jesse Ventura decided not to run for the Greens was because he saw how unfair the primary process was and that Howie was basically the annointed one. Howie Hawkins campaign manager was also the Chair of the Illinois party!

  12. Jill Stein got primary season matching funds in time to use them to pay petitioners. Hawkins still hasn’t received his primary season matching funds. That is the biggest reason for the decline in ballot access for the Green Party presidential ticket. Nevertheless, Hawkins is on the ballot in 6 of the 7 most populous states (all but Pennsylvania).

  13. The Greens were not putting much effort into ballot access. I don’t think they knocked out any state where it is legal to do it before 2020. The Libertarian Party knocked out ballot access in Arkansas and North Dakota last year, and the Constitution Party knocked out ballot access in Arkansas and Hawaii last year (but of course they suffer from a lot of internal problems, and are in worse shape than the Green Party in terms of ballot access). Also, after the COVID scare started, some of the Greens seemed overly paranoid about COVID, mistakenly thinking that COVID meant it was impossible to gather signatures. This line of thinking was a big mistake. Lots of people were out gathering petition signatures for various candidates and ballot initiatives all over the country, and I am not aware of one petition circulator dying, or even getting sick, from COVID. Some of them bought into the fear mongering and propaganda, and now they are paying the price.

  14. Jesse Ventura has been talking about running for President, but never actually doing it, for 18 years, so I do not think him not running, in spite of the Green Party of Alaska putting him on the ballot without his consent, had anything to do with anything that the Green Party did, or did not do.

  15. It’s true that I challenged President Obama’s Goldman-Sachs occupied White House in a handful of Democratic primaries in 2012, but I publicly supported a third-party ticket in that year’s general election. How’s that hypocritical?

  16. Can this go all the way to the US Supreme Court or is this something they probably wouldn’t touch

  17. Covid is a total myth. It’s actually milder than the common cold if it even really exists at all.

  18. The ultra-corrupt and increasingly totalitarian Democratic Party machine is trying every dirty trick this year to prevent the Green Party from appearing on the ballot. They need to be punished at the polls. Trump getting re-elected would be the perfect punishment for them…

  19. I agree. We need a greens for Trump movement in states like Pennsylvania and Wisconsin where democrats kept greens off the ballot.

  20. As a Libertarian, if my candidate was kept off the ballot by the duopoly I’d vote for Green before R/D

  21. We need every Green to go Orange/red for this one time. Or we’ll all be singing the gulag blues.

  22. Why the hell would there be a Greens for Trump movement when, in both Pennsylvania and Wisconsin, a Howie Hawkins write-in will be counted, as far as I’ve been made aware? Don’t vote for Trump when you can still have a counted vote for Howie.

  23. I do not think that is up to date. I think Hawkins will be on the ballot in 30-32 states, plus DC. That is still a big drop from the 44 states plus DC which had 2016 GP presidential candidate, Jill Stein.
