Professor Lawrence Lessig Column Advising States Not to Require Presidential Electors to Vote for Dead Presidential Candidates

Law professor Lawrence Lessig has this op-ed, strongly advising states not to pass laws that require presidential electors to vote for presidential candidates who may have died before the electoral college votes. Six states have a flawed law in effect that replaces presidential elector candidates who don’t vote for the person who carried that state, even if the candidate is dead.

  1. A good point. Thus, there is an opportunity, as well, for assassins between the day that the electors are chosen, and the day that they vote.

  2. Presidential Electors are voters. General electors are voters. No voter should be compelled to vote for anyone dead or alive. Nor should voters or Presidential Electors be prohibited from voting as they choose. Compulsory voting by Presidential Electors is the extension of ballot censorship in all ballot access laws.

  3. Well, I disagree. I think Horace Greeley, who died shortly after election day, would have been a more honest president than Grant. As they say – dead men don’t lie.

    And what would be a better fit fo present day American politics than a cabinet of dead zombies? Besides, don’t all the dead voters the Trump cult have been complaining about deserve representation?
