South Dakota Legislature Passes Proposed Constitutional Amendment to Require Certain Initiatives to Pass with 60%

On March 4, the South Dakota legislature passed HJR 5003. It would change the State Constitution, so the voters will vote on the idea in November 2022. It would provide that initiatives to change the state constitution, and also initiatives to pass a statute that result in the state spending at least $10,000,000 additional in the next five years, can’t pass unless they receive a popular vote of 60%.   1. UGGGGG!!! South Dakota has already passed legislation to make the initiative process more difficult, and now they want to do it again. If it is made too difficult, it becomes practically unusable, and then the process might not as well even exist.

  2. Conservatives are upset that liberals and libertarians used the process to legalize the “mary jane”.

    They didn’t mind the process, when they were banning gay marriage and civil unions.

  3. When Republicans have a majority in a state, they attack ballot access, and when Democrats have a majority in a state, they attack ballot access.
