California Senate Passes Bill to Replace “Disobedient” Presidential Electors

On April 26, the California State Senate unanimously passed SB 103. IT provides that presidential electors who do not vote for the candidate they are expected to vote for will be replaced immediately after casting their vote in mid-December. It also requires political parties, independent presidential candidates, and write-in presidential candidates to file not only the normal 54 elector candidates, but another 54 alternates.

This will be especially burdensome for declared write-in candidates, because their candidates for presidential elector are each required to file a notarized declaration of write-in candidacy. Already it was quite burdensome for write-in candidates to submit this paperwork. But under the bill, they will now be required to have notarized statements from 108 individuals (54 candidates for elector, and another 54 alternates). Here is the text of the bill.

Oddly, the bill does not require independent presidential candidates to include alternates on their petition. Under the existing law, all the candidates for presidential elector must be printed on the petition, which is quite cumbersome. Their address must also be included. This makes the petition form quite unwieldy, and is not necessary.

  2. Elector candidates should only be bound by pledge to their parties, if their parties require it, and the parties should determine the punishment for electors who violate their pledges.

    The state law should not bind any elector in any way.

  3. California’s statute for presidential independents is quite odd. It is the slate of independent electors that is running. It is only if all the elector candidates agree on a single presidential candidate that they are permitted to have a presidential candidate name appear on the ballot.

  5. The fiction in these faithless election laws is that the elector has resigned if they fill in a ballot with a name of another candidate.

    It would be like an ordinary citizen bringing their ballot to the election judge, and the election judge examining the ballot before depositing it in the ballot box.

    California could appoint electors independently, perhaps by lottery. They would be issued identical gray suits, and trained to march in lockstep. It would be a state occasion as cohorts of electors, alternate electors, and alternate to alternate electors march past the reviewing stand turn their head and salute the governor.

    It could be a criminal act to not vote the for the correct candidate. But few would even try as they would be blessed to be in the presence of the state leaders.

And that’s a relief after the former guy, a relentlessly attention grabbing narcissistic psychopathic and sociopathic con artist. The ratings which matter for Biden are not tv viewers for his speeches (he’s not a reality tv star after all) but job approval – above water, which the former guy never achieved once in four years, 90% among democrats and above water among independent voters – and policy approval.

    All of his policies are even more popular than he is personally, especially when described in more detail rather than less. That includes the support of a big chunk of Republican voters, but zero Republican politicians.

    The former guy can keep his t.v. ratings. He’ll probably get plenty of them for his upcoming criminal trials. Biden will get something better, two successful terms of passing his policies into law, a Democrat succeeding him in office, and a nation and planet that’s better off as a result.
