New York Now Has the Nation’s Most Restrictive Ballot Access for President, when the Easier Method for President is Compared in Each State

As a result of hostile ballot access changes in New York in 2019 and 2020, New York now has the nation’s worst ballot access law for president, if one compares the easier method to get on the ballot for president in each state.

New York has the 2nd earliest deadline (only Texas is worse).

New York has the shortest petitioning period for president.

New York is the only state that bans out-of-state circulators for all methods that might be used by a minor party.

New York has the third highest number of signatures in 2024, to the extent we can predict what the 2024 requirements will be. If 2022 were a presidential election year, New York would be the third highest, behind California and Texas.

None of these facts appear in Judge John Koetl’s May 13 opinion.

Even under the old law, when the petition requirement was 15,000 (1992-2016) or 20,000 (1972-1988), and the deadline was in August or September, many important minor party and independent presidential candidates failed to get on in New York. In 1972 and 1976, the presidential candidate who placed third in the nation failed to get on in New York. In 1984, the presidential candidates who placed fourth and fifth both failed to get on in New York. In 2008 the presidential candidate who placed fifth failed to get on in New York. In 2016, the presidential candidate who placed fifth nationwide failed to get on in New York.

    How many more to come via usual suspect MORON ballot access lawyers and worse judges unable to detect EQUAL in 14-1 Amdt ???

  2. Elections have become too important in this country to trust the voters with actual choices.

  3. The legislature in New York is smarter than than in Georgia. In Georgia they dream up all sorts of nit-picky rules to discourage people from voting. In New York, they just don’t want you to have any choices in the first place. What difference does it make in New York if aliens vote? The election is decided by the time they print the ballots.

  4. What a shame the supposedly most democratic country is the worst when it comes to fair ballot access and voting, including counting votes. It’s like a third world country. What’s the point in voting if you have most of the time just two political party’s on the ballot and they kiss the SYSTEMS butt. A true and honest democracy would have a lot of parties on the ballot with lots of choices between different ideas.

  5. The U.S. is not the worst in the world. Iran won’t let anyone run if that person has not been approved by the religious leaders. Russia, China, North Korea, Vietnam are also worse. And a few countries, like Saudi Arabia and Cuba, don’t even have elections for the most powerful offices. And in some countries, like Myanmar, elections are held but if the military doesn’t like the outcome, it overthrows the elected officials.

  6. New York doesn’t want the communist splinter parties on the ballot, because it will hurt the Democrats, who are pretty much communists these days.

  7. States like New York and Massachusetts have election systems that are more efficient than those in Communist countries. They don’t have to engage in overt political oppression. The ballot barriers are set just so enough token Republicans get on the ballot to present the facade of electoral choice, but the outcome in favor of the Democrats is pretty well assured. China would learn from them.
