California Superior Court Judge Laurie Earl has issued a tentative opinion in Heatlie v Weber, 34-2021-80003690, which says that Governor Gavin Newsom’s ballot statement, which says the recall against him is led by Republicans, is truthful. In California, in civil trial courts, judges issue tentative opinions before hearing the case, indicating the thinking of the judge. It is always possible for a judge to alter the tentative opinion after the oral argument, but generally tentative opinions and final opinions are identical.

This Judge is either incredibly naïve and doesn’t realize that Democrats regularly smear left-wing dissent as Republican (or Russian), or she’s in on the smear despite her nonsensical claim that that is not what Newsom was implying.
I think she is saying that the challengers have not demonstrated that Newsom’s feverish claims are false, and not merely hyperbolic rhetoric of a candidate seeking to cling to office.

It’s time to reform the recall system. The Republicans have used it twice in less than 20 years in California and can’t elect anyone dog catcher any other way here. Has any other state had a recall? I don’t remember one in 50 years before that in California either. We need to make it a lot harder so a recall happens only when a lot of people really want one, not just the 1% Republican filthy rich fascist scum.
1. IMO, the voters are the final judge of the truth or falsehood of what any candidate says. That’s what elections are for.
2. It’s interesting how recall elections are often packed with candidates, while regular elections have too few. We need to make it easier for candidates to get on the ballot in a regular election in the first place.
3. California is too big a state to be governed according to the wishes of most Californians. It should be split up into smaller states.

Good luck. There have been many, many proposals but the last time a state was successfully split was over 150 years ago, and it took a civil war to do it.
