Congress Passes Electoral Count Reform Act of 2022

On Friday, December 23, Congress passed S4573, the Electoral Count Reform Act of 2022. The Senate had passed it on December 22 by a vote of 68-29, and the House passed it the next day by 225-201.

This is the first federal election law bill to pass since 2002, when the Help America Vote Act was passed, outlawing punchcard ballots and mechanical voting machines. The 2022 bill makes it virtually impossible for state legislatures to ever take away the right to vote from ordinary voters, in presidential elections. No one, whether cis or trans, gets to choose what sex they’re assigned at birth.   18. That is where I first heard Shazbot, on Mork & Mindy. I think the word was also used in an AC/DC song. I think the TV show came out before the AC/DC song.

Hopefully President Trump’s very first executive order when he is restored to his rightful office will make that legal in all states. I know many law enforcement officers and veterans who would love to be the judge, jury and executioner in such cases if it didn’t involve the risk of ending up on the wrong side of the bars ourselves.

I wouldn’t say ECRA makes it impossible or even puts up any particular barriers to a state legislature reverting to legislative selection or some other method besides popular election of presidential electors. All of the provisions tied to popular election specify (as did the old ECA) that they only apply if that’s the method a state has chosen. ECRA does clarify that states can’t change their mind after the fact, that they have to choose their method by Election Day and that’s final, so no convening the legislature in December to pick different electors or anything like that. But if a state decided ahead of time to use some other method, as is their constitutional right, I don’t think ECRA presents any challenge to that. One minor practical problem (though this isn’t new) is that a state using legislative selection would have to conduct that process on Election Day. Which would probably be a headache for legislators, but it’s not impossible and is a pretty small problem compared to the political outrage that would ensue over abolishing popular election. The latter is why I really doubt we’ll ever see a state try it.
