As reported earlier, on February 17, the Eighth Circuit struck down South Dakota’s petition deadline for initiatives, which was an entire year before the election. The state has not asked for reconsideration and the time for requesting reconsideration is now passed. SD Voice v Heidelberger v Noem, 21-3195.
When do you think the new initiative petition deadline will be?
The deadline used to be in May, I think around mid May, of the even year. It got moved to November of the odd year after 2006, as there were several initiatives which qualified for the ballot for the 2006 election which the ruling establishment did not like.
