New Jersey State Court Keeps Fusion Lawsuit Alive

On May 2, the New Jersey Superior Court, Mercer County, Appellate Division, issued an order in In re Tom Malinowski, A-003542-21T2. The order denies the state’s request to dismiss the lawsuit on procedural grounds. The lawsuit challenges the New Jersey ban on fusion.

  1. Political parties have an associational right to nominate the candidate from another party, if they so choose.

  2. And, further, the decision whether or not to accept multiple nominations should be left up solely to the candidates themselves.

  3. Altho, parties DO retain the right to withdraw a nomination from any candidate whenever they become dissatisfied with that candidate

  4. The problem there is the whole notion of nominations and candidates. No such thing exists under my proposal.
