On July 10, the defendants in Libertarian National Committee v Saliba, Michigan e.d. 5:23cv-11074, filed their brief. This is the lawsuit in which the Libertarian National committee sued the faction of the michigan Libertarian Party that is in disfavor with the national committee.
Here is the brief. The defendants also filed a great deal of evidence.

As Chair of the original committee drafting the LP Bylaws at the 1972 founding convention and subsequently serving on the Judicial Committee, but not currently, I have not been asked to testify on these matters in Michigan. I would do so if requested. I hope the court will render a decision the contending parties accept. I may comment publicly in the future.

  16. There have been factions in the Libetarian Party from the beginning. In the 1970’s there were conflicts between the minarchists and the anarchists. But, for a long time, Libertarians were able to agree to disagree.

    For some reason, this no longer seems the case. IMO, the party ought to allow competing affiliates within a state. Let the best affiliate win. This is not such a crazy idea. The Liberal International recognizes more than one affiliate in a number of countries.

    But, if that doesn’t work, maybe its just better to create new parties out the factions. The party isn’t a sacred institution, nor should it be.

  22. It used to be that Libertarians were defined by whether or not they subscribed to the NAP. Are they now to be defined by whether or not they belong to a franchised affiliate that is recognized by the trademark holding organization?

  23. Virtually all long-lived national political parties in the U.S. have suffered from factionalism. This is true of the major parties and other parties. It is also true for churches and many kinds of other private organizations. But no one ever thought the answer to factionalism was the trademark law.

  26. None. The USSR had no businesses or private entities. Everything was government. There were no legal private businesses except during an early experimental plan and right towards the end. If Nazis had trademarks, it was only because they were never fully socialist in practice. Free economies have trademarks. It’s a hallmark of private property.

People who could afford it, and didn’t have a billion and a half chinamen with a giant navy, giant army, rapidly gaining economy, intercontinental ballistic missiles armed with nuclear warheads, etc, etc, etc to worry about.
