U.S. Supreme Court Justice Clarence Thomas Asks Miami for a Quick Response in Racial Gerrymandering Case

On August 4, the Eleventh Circuit stayed an order of a U.S. District Court that would have required Miami to use a different redistricting plan for City Commission. The U.S. District Court had determined that the city’s redistricting plan is a racial gerrymander, but then the Eleventh circuit said the U.S. District Court should not have ruled so close to the upcoming election.

On August 6, the plaintiffs in the case had asked Justice Clarence Thomas to countermand the Eleventh Circuit.

On August 10, Justice Thomas asked the city to respond no later than August 14. The case in the U.S. Supreme Court is Grace v City of Miami, 23A116. Here is the brief filed in the U.S. Supreme Court by the plaintiffs.

Justice Thomas is handling this because he is the U.S. Supreme Court Justice who handles emergency requests from the Eleventh Circuit, when the U.S. Supreme Court is not in session.

    I was about to say Miami is too large population for my plan, but I must have remembered incorrectly, or else was thinking of the metropolitan area or county rather than the municipality. 400 k is within the one order of magnitude margin of error I conceive, although ideally it would be four precincts (or whatever you wish to call them). I have not looked at the district map, but if the 5 districts are contiguous and somewhat natural in geographic or demographic terms (admittedly, a big if) they would each be closer in size to my ideal sized government than Miami as a whole would be.

    I don’t see Miami as the best place to immediately implement my plan. For one thing, immediately implementing all of it anywhere would he too disruptive. I prefer gradual transitions with time to see whether real results confirm theoretical expectations where possible. The cultural changes envisioned in my plan also take time. I have no desire to have a top down version of my own “new soviet man” or its converse.

    Miami isn’t ideal for the rapid implementation of my plan, or if it was to be implemented anywhere all at once, it wouldn’t be among my top choices. It is far too cosmopolitan with rapidly changing population. A hundred years ago the population was less than 10% of the current level; at the preceding turn of the century, a mere 123 years ago, it was a fraction of 1% of the present total. The demographic and cultural character of that population has also changed greatly. The number of Miami resident men who own and habitate land owned by his father, grandfather, and the grandgather’s father and grandfather must be miniscule, if indeed any such men even exist at all.

    For relatively rapid implementation of my plan, or a full scale test, I’d prefer places with a relatively homogeneous long term resident population. For example in the United States, rural West Virginia or central Pennsylvania would be a good example. In Florida, I would pick the northernmost part of the state. Among my three residences, I would select my ancestral lands in rural Moscow region first, center city Moscow second, and Sochi area dead last due to its population explosion very much along the lines of Miami within approximately the same timeframe. Central Moscow, while it has been populated for many centuries, has had a great deal of population turnover and rebuilding, and Soviet laws played chaos with property title. My ancestral lands in rural Moscow region, which I repurchased, have a relatively stable long term population, despite Soviet laws equally screwing up intergenerational property ownership rights, as they did everywhere in the former USSR.

    Miami districts aren’t the largest. New York and Los Angeles council districts are approximately a quarter million population each.

    AZ, as usual, seems incapable of rudimentary research. The population of Miami-Dade county is at latest census over 2.7 million, much larger than the city of Miami. I wasn’t entirely wrong in my recollection that it seemed much larger than a city of 400k. As I suspected, I was confusing the county or metro area (which includes additional counties) with the municipality. The research on the numbers took me 15 seconds. AZ would do better to repeat himself less and attempt to learn something from time to time.

I’m quite good at arithmetic, statistics, and the like, but I have the same questions as Kyle. AZ doesn’t use standard mathematical notation or standard English grammar. Combine his seld-created shorthand jargon in both and you have a jumbled mess I do not have the patience to decipher. However, to the extend my quick scan determined the meaning of what he wrote with his calculation example, it did not answer any of Kyle’s questions. Kyle’s questions still stand. Predictably, AZ is the troll who pretends he answered them when he did not, or the moron who actually thinks he somehow answered them.

  13. I really don’t care. It’s not as if the AZ plan is about to be implemented anywhere. If he wants to make it more trouble than it’s worth to understand it, that’s on him. I understand parts of it, and disagree with the vast majority of those. If AZ needs a public audience to yell gibberish at himself, I don’t feel compelled to linger and provide such audience, much as I would not for presumably homeless individuals who exhibit a similar need for public audience for their yelliing, insults, and indecipherable repetive rants, such as you would find in sections of any large city downtown.

    As for the Max plan, it seems very good directionally. As Maxim himself points out, it should be implemented slowly and carefully, and not exactly the same everywhere. I agree with that.

In thinking about it a bit more, if an actual local test of my plan were possible, my favorite place in the United States to begin would (unless someone has a better suggestion) be northernmost parts of Maine and New Hampshire. That area has been populated by White men since the 17th century, with relatively little population replacement or demographic change. Property ownership tends to be relatively stable.

    The population is overwhelmingly White and Christian. New England has the town meeting tradition, which is one of the inspirations for my plan. The residents of that area tend to be well armed, relatively self reliant or mutually self reliant, and used to hard physical work, especially on farms, cutting timber, etc. Extended family ties and close long term next-generation connections to local communities abound. Almost everyone has at least one mutually understood language, and many common cultural traditions. The area tends to have a conservative-libertarian political character. If secession were to become plausible, it has coastal access and a border with Canada as well as a new one that would exist with the US, were those entities to remain intact for the time being at that point.

    If anyone can think of a better place to test my proposals in the United States, please say where and why. I know that presumes a luxury to choose a place, which seems unlikely. Nevertheless, I see it as a useful theoretical exercise for various reasons.

  21. I’ve lived in places which are significantly colder than Maine. Where I live now is comparable on average climate to northern Maine. However, I have no interest in moving. As mentioned many times I have no interest in trying to establish a “Maxzim regime.” Also, I’m the furthest thing from a defender of the Soviet system.

    I’m in touch with a number of people in the US, including Maine, who side with Russia against the Nazi occupation regime in Kiev, as well as many more who hold no opinion except that the United States should not take sides. Contrary to AZ idiotic statements, it’s highly unlikely anyone in Maine would attack me for opposing the fascist Ukrainian government. Even if they disagree with my opinion, unlike fascist communist AZ, they generally don’t consider it “justice” to physically attack me simply for holding a different opinion.

    I was trying to have a civilized conversation with civilized people.   23. Also, I think Max is selling his plan short. Miami is less than ideal, yes, but that just means it needs the Max plan, or progress towards it, all the more. Being less than ideal just means that the gradual roll out would be different than in northern Maine or Appalachia.   31. Each candidate chooses precincts with 1/16 of the electorate. Voters vote for one candidate running in their precinct. Top 79 are elected. Candidates outside the top 79 may transfer votes to other candidates who ran in their precincts.

    Councillors exercise the number of votes they received. If a candidate received 5671 votes they get 5671 votes in council meetings.

    Walter Ziobro, I agree that bigger cities can have multiple separate governments. In fact, this already happens; it was pointed out above that Miami-Dade county has 2.7 million people, Miami municipality around 442k, and I’ll add that a further quick search reveals that the Miami metropolitan area has over 6 million people. I see no reason that metro couldn’t be 60+ governments, and they don’t necessarily need a metro federal council.

Just the calculation of votes, both to elect the politicians and of their own votes once elected, would be time consuming, prone to software error, and prone to deliberate vote tabulation fraud. There’s already far too much of any of those things as it is.

    Why is this necessary at all? It seems to be taken as a given that every level of government requires a massive legal code which is impossible for anyone to remember and understand,but which they can nevertheless be put in a cage at taxpayers expense for violating any aspect of. Furthermore, if that wasn’t bad enough, that this complicated legal code needs to be continuously revised, to the point that people whose full time job it is to debate how to revise it have to be elected – by everyone, including young adults who are children in all but name, hysterical women, paupers, lunatics, vagrants, criminals, unasimilated aliens from uncivilized third world crapholes, narcomaniacs, etc – with the positions being highly sought, and whatever they come up with must nevertheless be so open to interpretation as to require the further services of highly trained professionals to adversarially arbitrate?

    In addition, that these elections of the persons to be paid full time to argue over and revise the shelves of books of legal code must be carried out over multiple voting places by secret ballot, inviting fraud at multiple stages of the process? And that the people voting be by and large strangers to each other and to the managers of the voting process, requiring trust that the complicated system used to ensure that only eligible voters participate, and that each such voter only do so once, is not intentionally or unintentionally mismanaged?

    Why is all of this taken by virtually everyone as not only the best way to run things, but indeed inevitably the one and only way? To me it seems blindingly obvious that some things have gone terribly wrong to bring us to such a pass, and that there must be a simpler, more logical way to manage government, starting by keeping it out of things other than protecting citizens from crime and foreign attack.     I will address the issue of my proposal vs. the status quo in Miami (5 member council elected by district) and not your fantastical idea that has no chance of being adopted.

    Voters would go to a polling place and mark a paper ballot which is deposited in the ballot box. At the end of the voting day, ballots would be taken from the ballot box and tallied by tellers. The ballots would be returned to the ballot box which would be locked and taken to city hall, where all votes would be tallied.

    Counting weighted votes in council is trivial.

    Councillors need not be paid a large amount. Miami has a city manager to actually run the city.

    Under the current system the city is divided into five districts of equal population, regardless whether the population naturally divides into five communities of equal population. The elected councillors may or may not represent many persons living in their district. The current litigation is intended to influence who is elected in the five districts. When it is said that a certain groups is able to elect its candidate of choice it means that other groups will not be able to elect the candidate of their choice.

    Under my proposal all voters will be able to choose their representative. If more voters choose a particular representative, that representative will be able to exercise more authority.

He’s been very clear that he does not expect, or even want, immediate implementation of his whole plan. His question about why the things he asked about are such a consensus makes a lot of sense. I have no answer to it myself.

  43. I enjoyed the fake news spin on our economy. In the real world, my investments and businesses are doing great. I do have some accounts in various currencies, including Rubles, but the vast majority of my wealth is in assets, including real estate, stocks, crypto, precious metals, collectors items, and direct ownership stakes in non-public companies. A weak Ruble doesn’t have any appreciable negative effect on my overall well being. I’m having a record year in overall profits, but thanks for your “concern.”

    There is a Russian Orthodox Church in Miami. There may be parishioners who would be interested in your concepts. We need some terminology. How about “autonomous community” and “big men” and “meeting” which has less of a connotation of government. I don’t how you would enforce the requirement for large tracts of land under cultivation with 100s of farm workers attached to the land. Perhaps they can gradually acquire land. In Miami, you can likely grow vegetables and citrus, so farming is more intense on smaller tracts of land.

    The big men need not be orthodox, but they could verify the faith and race of others.

    So the big men would meet and declare an autonomous community. As a startup would they be permitted to meet more often than once a year?

    How would you handle the airport and port?

  49. Thanks Jim, as it happens transition steps have been on my mind today.

    I don’t think anything that dramatic is necessary as a starting point. I think where I’d start is with simplifying local laws and governance as much as possible. I would encourage law enforcement professionals to run for all local elected office on a platform of simplifying local laws and regulations, and making punishment for mala in se crimes as swift, sure and severe as state and federal governments would allow. Where county level government victory could be achieved (probably not Miami-Dade in early stages) part of the platform would be making cooperation with federal law enforcement and bureaucratic activities more than a mere formality, extending the least cooperation with the feds that could be extended without federal military invasion. Further steps can be taken once state governments are in play, probably starting with low population conservative states (Wyoming, Montana, Idaho, Dakotas, Alaska).

  50. Additional first steps would be from the cultural side :

    Encourage religious homeschooling

    Propagate ideas of the dark enlightenment

    Encourage early marriage and traditional families

    Encourage military and law enforcement service

    Encourage weightlifting, target shooting, hunting, fishing, martial arts and combat training for boys and young men

    Encourage traditional roles taught for girls and young women, study of religion and home economics

    Encourage young men to farm, learn trades, and serve in military and law enforcement rather than attend university, especially avoiding liberal arts universities

    Encourage them to join ROTC, police athletics leagues, law enforcement auxiliaries, neighborhood watch, civil defense, militia etc

    Encourage theological training, and for young men well versed in dark enlightenment to go into religious leadership

    Seek men with such backgrounds more firmly developed to run for local office

    These are some good cultural first steps.

    Criminal laws are generally matters of state law rather than local law. Local law enforcement apprehends apparent criminals and turns over prosecution to state attorneys. Any punishment would be by the state.

    It is not clear what you mean by swift and sure punishment. State and federal law would require due process.

  54. If the criminal laws are state, what’s the purpose of the local ordinances? If all local law enforcement does is turn criminals over to state attorneys, why do you have both local and state law enforcement agencies?

    I’m open to arguments that some specific existing ordinances serve some necessary purpose, if you want to cite some and explain why they are so indispensable. Ideally, I’d recapture local sovereignty over criminal law.

    As far as non cooperation with federal agencies goes, I’d start with things like environmental and labor laws, tax laws, gun laws, and things of such nature.

    Overall, unwinding such a complex system is more complex than I would know how to do. The USSR collapsed from the top down, and I would hope the same could be possible in the US. I’d also wish to see further progress here. My favorite time in Russian history was before Mongol yoke and Empire, when we had city-states, boyars, princes, etc.

    The (People of) a State are sovereign. Most States are divided into counties for administrative purposes. This permits citizens to elect the officers who administer the area. The sheriff arrests criminals, they are tried in a county or district court, and if convicted, sent to a state prison.

    State police typically only provide backup and specialized investigative support.

    If you follow the link to each agency, there’s an external link to its website, if you or anyone doubt that these agencies all exist. There are also state level courts.

    In addition to a cornucopia of state prisons, there are also county jails in every county, housing both convicted and accused criminals, sometimes for years. Many cities also have separate city jails.

    Furthermore, you also have a wide variety of federal law enforcement agencies, courts, and incarceration facilities, many overlapping specific subjects of state and local agencies. You can find a (partial?) listing elsewhere under the same wiki, again with links to separate articles with external links to the agencies to verify they are real.

    Additionally, the article lists numerous university, school district, airport, native, and railroad law enforcement agencies, as well as private corrections facilities.

    All this seems insanely and unnecessarily complex to me. As far as I can tell, my questions and statements above from the 21st still stand. I also continue to be of the opinion that the US, state of Florida, every other US State, Miami-Dade county, and even the City of Miami are larger than optimal size for sovereignty. The city of Miami and the very few smallest population states are marginal, but each of the five districts of Miami are closer to ideal.

    Getting from here to there is admittedly a harder question. I’ve outlined some possible starting points. Chaos in the aftermath of systemic collapse is another one, albeit not optimal for other reasons. The model the collapse of the USSR suggests is to start with dissolving the USA into its constituent states and territories. Conversely, I’ve suggested some possible bottom up and cultural starting points.

    I readily admit I do not have all the answers on either the exact destination or, especially, the exact steps from here to there, and expect local variations in both. My main suggestions are along directions of movement and reasons therefor. Your mileage may vary, etc.

    The county and state circuit courts are courts where criminal cases under Florida law are tried, as well as civil cases under Florida law. One of the grievances of the 1776 rebellion/insurrection was that the British would transport criminals to England for trial, and would not permit jury trials by their peers.

    In the USA their was the concept of circuit courts, where the judges and lawyers would ride circuit, travelling from county to county to hear cases. A county might not have enough crimes to sustain a full time judge, bailiff, etc. So instead the judge and prosecuting attorney would serve the entire district, typically being elected, and would travel to each county for a week or weeks.

    If you were tried in Florida, the case would be styled People of State of Florida vs. Max’ They had old forms left over that read, ‘The Crown vs. _____’. Under British law a crime is committed against the King’s Peace. The King’s duty is to provide civil order so His subjects can go about their ordinary lives. The case is not specifically brought on behalf of the (alleged) victim. If the act occurred in Miami-Dade County, the case would be tried in a state circuit court in that county, prosecuted by a states attorney for that circuit (more likely by one of his many deputies), with a jury of county citizens.

    If you were considered a flight risk or likely to commit similar crimes of a serious nature, you would be incarcerated at the county jail, until your trial. If convicted and sentenced to prison, you would be moved to a state prison. There may be state prisons in Dade County.

Ultimately, it would be a lot less of an issue since part of the whole point of my plan is to drastically cut down on all forms of long distance commerce, travel, supply chains, relocation, etc. It’s obviously going to take quite a while to get from here to there. There are however hopeful signs, from advances in robotics and 3D printing (still a long way from Star Trek replicators, but making great strides) to remote control drones, etc. If technology keeps advancing , the vast majority of the raison d’etre for all that frantic moving people and things around the globe will be gone. Alternatively, if there’s a technology backslide due to war, environmental disaster, idiocracy, etc, the means for all that scurrying may become significantly less available.

    The new global trend toward pan-nationalism, localism (eat local, shop local, etc), tariffs and immigration controls is a very good thing. The collapse of large scale information gatekeepers, as well.

    Again, ideal winding down of globalism and excesses of “enlightenment” would take perhaps a century. Less ideally it may involve massive systems collapse, leaving no choice. But anything approaching immediately shutting all that down is too disruptive to be ideal, I think. The culture needs time to readjust.

    Decomposing a complex problem into smaller components is the whole point of my plan, if you think about it. Modernity has brought excessive complexity, to put it mildly, and it’s past time to recalibrate, integrating the best of traditional antiquity and modernity. I’m not for complete neofeudalism, just finding a good middle ground between historical norms and what has all too rapidly replaced them. Many of the old ways were better, tried and true over millennia, and discarded far too rashly and hastily ,absent a more complete analysis.
