Democratic Candidate for Virginia Senate Ballot Status in Question Due to Email Address Error

Here is a story about Virginia Senate Democratic Party candidate Trudy Berry, whose name may not be on the ballot in the 9th District in November 2023 due to an email address error that led to candidate paperwork not being filed on time. Ms. Berry is appealing to the Virginia Board of Elections for relief.

The Virginia Senate is composed of 40 single member districts, which are all elected in years immediately preceding Presidential elections. The Virginia House of Delegates is composed of 100 single member districts elected every odd numbered year. Virginia Governor, Lt. Governor (which are elected in separate elections), and Attorney General are elected in years immediately following a Presidential election.

  1. If she is too stupid to not understand how email works, she shouldn’t be on the ballot.

  2. IMO, the party should be the final judge of whether or not a candidate can run in its primary.

    The candidate filed with a party official who failed to use a correct email address in forwarding the application to the board of Elections. The party official subsequently died.

    In Virginia uncontested primaries are not placed on the ballot. The primaries were in June.

    The candidate apparently just noticed she would not be on the November ballot.

    If there were no partisan nominations the candidate would have filed directly with the state.

    It is likely that they mixed up the current map based on the 2010 Census and the new map based on the 2020 Census. The new senate district 9 is in the Southside (south of the James River and along the North Carolina line). The linked-to article in the OP said that Trudy Berry is running against Senator Frank Ruff. Ruff currently represents SD-15 which is similar to the new SD-9. The current SD-9 is in the Richmond area.

  7. The SBOE in a Tuesday meeting discussed the issue, but took no action, and simply went on to other issues.

    It is likely that nothing else will happen unless Berry files a lawsuit.
