New York Governor Signs Bill to Replace “Disobedient” Presidential Electors

On September 20, New York Governor Kathy Hochul signed S438.  It says that if a presidential elector votes for someone for president or vice-president whom his or her party did not nominate, that elector is deemed to have resigned.  The other electors then choose a new elector.  Here is the text.

  4. The Horace Greeley precedent was repudiated by the 20th Amendment. The proper scenario now is that votes are still cast and Congress still counts the votes for a dead person, who is then a dead president-elect so the VP-elect takes office. Otherwise, if the dead candidate had won, you could end up with their opponent rather than their running mate.
