Colorado State Court Rules Against Former President Donald Trump on Procedural Issues in Ballot Access Case

On October 11, Colorado state district court Judge Sarah B. Wallace issued an opinion in Anderson v Griswold, 2023cv-32577. This is the case that seeks to prevent former President Donald Trump from being on the Colorado Republican presidential primary ballot in March 2024.

The opinion clears away procedural objections to the lawsuit, and confirms that the trial will begin on October 30, 2023. Here is the decision. It says that there is a benefit to the public in keeping unqualified candidates off ballots, but does not cite any authority, and ignores the fact that in the past, Colorado has printed the names of presidential or vice-presidential candidates on its ballots who did not meet the age-35 requirement.   1. If there’s a trial, then Trump, in his defense, gets to introduce all of the evidence of the election fraud, right? Bring it on!!

  2. And, again, it’s all moot since we don’t actually vote for president. We vote for presidential electors where the presidential candidates names are just used as ballot placeholders for them. In the primaries, the votes are for the candidate’s delegates to the national convention, so same dif.

  3. Can’t the state affiliate just ignore the primary results entirely and just use some other mechanism at their state convention to appoint their national delegates?

    So ultimately it wouldn’t matter anyway… it would be up to the delegates to the state convention on what to do with primary results; I.e. ignore them.

    Or are there party bylaws that obligate them to accept those results? Could the bylaws be changed at the convention prior to finalizing of their delegates?

    I’m no Trump supporter but it seems like these lawsuits for primary ballot access are frivolous given a number of other mechanisms that could be used for Trump to be given those states’ delegates.
