As previously noted, the Minnesota Supreme Court will soon be deciding whether former President Donald Trump should be on the Minnesota March 2024 Republican presidential primary ballot. Growe v Simon, A23-1354.
On October 20, the Minnesota Supreme Court asked both sides to respond to the discovery that in 2012, the Minnesota Supreme Court had a somewhat similar case, filed to keep then-President Barack Obama off the November 2012 Minnesota ballot. The 2012 decision was not published and neither side in the current lawsuit seems to have known about it. In the 2012 case, Oines v Ritchie, A12-1765, the Minnesota Supreme Court kept Obama on the ballot. The challenge had concerned the “natural-born” part of Article II and the citizenship of Obama’s father.
In the 2012 decision, the Minnesota Supreme Court said, “Candidates for president or vice president of the United States are specifically exempted from the requirement of filing an affidavit of candidacy that demonstrates their eligibility for the office sought. Minn. Stat. sec. 204B.06, subd. 4 (2010). Instead, under federal law it is Cngress that decides challenges to the qualifications of an individual to serve as president.”

If a presidential ticket does have supporters in the House of Representatives to uphold the the voters choice, then they are not a “viable” candidacy. If I were to run for public office, I would certainly support fairer ballot access laws and things such as ranked-choice voting. As the most recently serving deceased former California governor, I appeal the ruling of the court that living California governors are eligible whereas dead ones aren’t. We’re all about tolerance and diversity in California, except for anyone who doesn’t march in lockstep to our cultural Marxist fascism. Such people must be sent to cultural reeducation camps until they are ready to rejoin society and celebrate diversity with the rest of our rainbow family. But setting them aside we are all about tolerance. That includes discrimination against Deceased-Americans such as myself.
In California, we believe Deceased-Americans must be treated with dignity, given full voting rights, and continue to be fully eligible for government pensions and social programs, which we demand keep sending us checks every month, as opposed to the discriminatory practice of cutting people off just because they died. We demand that every vote be counted, as many times as necessary, regardless of whether the voters are alive or not.
We also demand that binary classification of people as either living or dead must stop immediately. That concept needs to be swept into the dustbin of herstory along with icky binary gender constructs.
