The brief argues that the Lanham Act, the federal law concerning trademarks, cannot be applied to settle factional fights within a political party.
The brief is well constructed and pursuasive.
I think you said that the last time before the injunction was issued, so we’ll see. My guess is that the national party will ultimately prevail, as it should. I’m not the amazing kreskin by any means, but my livelihood essentially boils down to guessing correctly, so I’m at least somewhat better at it than a lot of people. Elected fake libertarians are real people who are really elected. The fake part is their alleged libertarianism, not their existence or elected status. Real libertarians who never ran, but win in other ways – Hoppe, Rockwell, Deist, Woods, many others. Only a small minority of libertarians operate in the libertarian party. Most are Republicans, anarchists, constitutionists, independents, etc, etc. Most Jews are not Israeli (although maybe that’s no longer true), most Arabs are not Saudi, most Africans don’t live in a country which includes the name Africa (I think only South Africa), most Americans are not US Americans (all of North and South America people are American in the sense that Europeans, Africans, Asians, Australians are folks from a continent , not a country except Australia.)
Libertarians who are not with that party can be real libertarians, and ones who are can be fake. Again that does not mean fictitious persons, not real candidates or officials, they can be all those for real, just fake libertarians.
Your contentions about real libertarians require proof to be taken seriously. Otherwise, they just sound like petulant, childish name calling. I think Joe is right. As I mentioned, fake libertarians hardly controlled the entire party. RON PAUL was the 1988 presidential nominee after all, and although he won actual office as a Republican and much more support as a Republican candidate for the Presidential nomination, he was never the nominee. His participation in both parties led to a lot of Republicans, independents, and others who call themselves libertarians.
More people joined the movement and called themselves libertarians than ever before. Some found their way to l.p. Others not so much. Some are doing so now but l.p. still needs to prove itself to them. Or not yet because TRUMP is very good and Biden is very bad from a libertarian perspective.
However not all Republicans are good so there’s room to for example register libertarian and vote Republican. Or vote for Trump and local Libertarians. Or maybe you live in a state where the Presidential vote is heavily R or D and there is no real chance the LP vote changes the outcome, so Trump winning or losing the state does not hinge on how libertarians vote. Then we might vote for the Libertarian for president, depending on who they nominate. But say the state or local races are competitive, we can might vote Republican or Libertarian case by case. Certainly, the keystrokes can’t really criticize us for lack of party loyalty.
So unfortunately in 1989 Ron Paul supporters lost the LP chair race very narrowly and the LP lost a lot of real libertarians to the GOP, including Ron Paul himself. But then only a few years later, the LP made a big membership growth push in the 1990s, mostly targeted libertarian-conservative and liberty Republican lists.
Then after 2001 and 9/11 it lost a lot of those supporters again. But as the Iraq war dragged on the movement grew outside the party. In 2008 Bob Barr did not impress and actually repelled a lot of Ron Paul libertarian Republicans. They went in a lot of different directions from Constitution Party to Green, Republicans to Democrats to writing in Ron Paul or sitting it out and more. Some did vote for Barr but otherwise did not support or get involved. Then Barr himself went back to GOP too.
When Johnson ran as a Libertarian and Ron Paul as Republican again for the same office was really when the fake libertarians took over the LP. This became worse as Johnson ran again with a real turd named Weld , Czarwark was chair for I think 6 years, and then his Henchman, they maligned the Mises Institute and Blood and Soil Libertarians , talked about running Weld for President (until he got drunk and decided to waste his time running against Trump in the primaries). So they ran Marxists who supported BLM instead and even had openly communist candidates for national party chair.
Well during this time especially after the Weld debacle and him basically endorsing Clinton while in theory running against both her and Trump, among many other things, it was embarrassing libertarians who were not even LP just due to being called by the same name. And then more of the same with the pro Weld chair saying ugly things about the Mises Institute. Enough was enough. The Mises Caucus started. It took 3 conventions but they steadily gained strength and won! The Republicans and Libertarians are now both moving in a pro liberty direction, and true libertarians are at the very epicenter of both! Exciting!
