California Secretary of State Issues Advisory

On December 8, 2023, California Secretary of State Shirley N. Weber, Ph.D. issued an advisory to County Clerks and Registrars of Voters of that state’s list of “Generally Recognized Presidential Candidates. The list contains the names of the candidates that the Secretary of State intends to place on the ballot at the March 5, 2024, Presidential Primary Election. The Secretary of State has determined that these candidates met the “generally advocated for or recognized” criteria as set forth in Elections Code section 6000.1.”

This may be just a preliminary list of candidates.

  1. How do they come up with that? Over the years I’ve been involved in the Republican, Libertarian, and American Independent parties. Granted, that last one was in the 1960s and 70s.

    I’ve heard of neither the sole libertarian nor sole AIP candidate on that list, and about half of the Republicans and Democrats. I’ve heard of the only Green, and, thanks to this site, all of the P & F candidates (otherwise, I would have only heard of one of those).

    I’m aware of at least 6 libertarians running, none of whom are on that list. Thus my question.

  2. I have been in the LP since 1996 and I follow this stuff more closely than most people and I have never heard of Charles Ballay.

  3. Wouldn’t each of these candidates have had to submit a notarized statement? If so, either someone out there has legally changed their name to “President R. Boddie,” there is an obvious forgery involved, or California elections just doesn’t care.

    The candidates are selected by the Secretary of State (SOS) based on her observations of their activities, OR by following: “has a current presidential campaign internet website or webpage hosted by the candidate or a qualified political party, and a written request submitted on the candidate’s behalf by a party qualified to participate in the primary election to the Secretary of State requesting the candidate be placed on the presidential primary ballot”

    Also: “On or before November 28, 2023 (E-98), a candidate shall file with the Secretary of State a form of ‘Proof of Generally Advocated for or Recognized Candidate’ and attach supporting documentation.”

    Other candidates may qualify by Dec. 15 by submitting “signatures from voters who have selected a preference with the
    party whose nomination is sought equal in number to not less than 1% of the number of persons who have selected a preference with their respective party in the 154-Day Report of Registration issued by the Secretary of State.”

  5. Back in the 1960s the Democratic Party would run a favorite son candidate, who would control the state’s convention delegation in a hopefully brokered convention.

    In 1968 Hubert Humphrey was nominated despite not being on the California primary ballot. The Constitution was amended to require the SOS to put “generally recognized” candidates on the primary ballot. Originally a subjective criteria it has evolved to a more objective criteria in statute, and the candidate has to submit an application demonstrating his qualification.

    I suspect Ballay has qualified by being on the Iowa Libertarian caucus ballot. That might only require a request since it is a non-binding straw poll.

  9. I don’t know who else he thinks he’s convincing or what he thinks he could possibly accomplish. But that also doesn’t matter because he will keep doing it more and more until he literally can’t .

    He’s a train wreck that already went off the rails. All that’s left is for the inevitable to play out. There’s no switching course, logic, reason, adjusting direction. Just accelerating until explosion.

    Having a conversation with that? Lots of luck. Around it? Nobody will hear you over the noise.

    This is an excellent opportunity for third party and independent candidates. Open seats give them the best chance to have an impact.

  11. Marginally, yes, but there’s still plenty of time for more retirements or even unretirements. There are a lot of factors that get touted as important for breakthrough success, and most have some marginal value, but by far the most important is candidate and candidate support team quality and effort.

    A large number of fringe candidates, fringe parties/factions, and perennial noncontenders make very obvious mistakes such as:

    Unmatched candidate – office pairing. I don’t say unqualified, because of course at least one of you will pipe up that there are legal qualifications. Of course there are, but there are virtual ones as well.

    You can’t apply for a CEO job at a major established company, a key position on a top ranked major league sports team, a 9 figure loan for a business startup, a top rank position in the military or a large established religious or charitable organization, a leading role in a major movie, etc, without a track record of success in something, family legacy, or something to separate you from the employment application equivalent of spam and junk mail. Well, you could, but then you could with similar odds bank in a strategy of winning top prize in megamillions lottery, winning multimillion lawsuits when a helicopter lands on top of your house while struck by lightning, etc.

    For everyone else, you probably have to start at the bottom and work your way up through ranks, with years of thankless mail room duties, potato peeling, changing bedsheets and bedpans, getting up in the middle of the night with the wind chill well below zero to feed hogs, pulling all nighters for exams, night watch guard duty, preparing book length reports that bored higher ups toss in the trash and/or take credit for, moving every year for farm team bench warmer spots, etc, etc.

    Even then, the odds are stacked against you if your expectations rise above mid level positions in your peak earning years after decades of consistent and largely unthanked heroic effort in serving a bored public, kissing undeserving butts, smiling convincingly, saluting, packing and unpacking boxes, exacerbating repetitive motion injuries, sitting in traffic, giving virtual or actual hand jobs, making or fielding customer complaint calls, and other similar activities (usually not all at the same time).

    There are several other such common sense things which single digit bound campaigns routinely skip, like door knocking, having an active team of support staff or volunteers , repeat contact, actively reaching out to media, looking respectable, having a non BS non joke resume, community involvement, not coming off like an escaped inmate or mental patient or the kid eating what comes out of his nose at the back of the bus, or like the corner three card Monte dealer in a stolen suit, etc.

    They run virtually unqualified candidates for top level offices, expect the media to find them, make very little or no proactive effort of any kind, don’t even try to hide the crazy, sell dope and shoplifted items and turn tricks out of the campaign van, use the same boiler room with the same phone exchange for the political campaign as they use for their crypto crapcoin pump and dump business and phone sex and psychic hotlines, have a three figure campaign budget if they even have one, spend 90% of campaign time arguing with each other over obscure thousand year policy goals or engaging online trolls or working on their anime furry convention sci-fi/fantasy comic novella series.

    Then they whine about how their 2% should have been 52%. And then do it again 2, 4, 6, 8, and 28 years later. Even if they don’t make rookie mistakes, they’re running against much better known, financed, connected opposition in a crooked game. The breakout opportunities come in unexpected places at unexpected times.

    Targeting districts? They’re lucky when they have anyone for anything, and it’s usually someone living in a halfway house with no money, volunteers or staff.

    Tl ; Dr good luck with that, I’ll skip the campaign strategy session and take some pig carcasses to the wholesaler. Maybe ride around looking for a good deal on stacks of used tires, check out foliage colors, etc.

  12. Whoever Charles Ballay is, it appears that he has done his homework. His website is quite detained and specific, whether you agree with him, or not.

    It wouldn’t surprise me that he anticipated the criteria that would be required for ballot access.

  13. He’s an ear, nose and throat doctor, and most likely could run a respectable campaign for parish council or state rep with a serious level of effort. Instead, he’s running for president of a 9 figure population international league turned nation state, and it’s a virtual guarantee his campaign site is his whole campaign given that even minor party insider political junkies never heard of him.

    Obviously, a more serious campaign than the half dozen winners whose campaigns also include weekend stops at state level annual cult revival meetings at several adjacent tables at a Denny’s (because they didn’t bother to book the back room and the local toastmasters did) and even possibly a county fair or two (“you’re running for president of what?”).

    It couldn’t possibly be that Commiefornicator election bureaucrats are the polar antithesis of everything libertarians claim to be working towards, regardless of their actual real world activities. They wouldn’t troll the el pee like that. They are fair and high minded civic servants and a shining example of why government should run even more of our lives.

  14. Currently, Congress is very evenly divided in both the House and the Senate. It would take just a handful of elected third party and independent candidates for Congress to become the balance of power.

    Although intervention in this Court is reserved for unu-
    sual circumstances, see S. Shapiro, K. Geller, T. Bishop, E.
    Hartnett, D. Himmelfarb, Supreme Court Practice § 6.16(c),
    p. 6–62 (11th ed. 2019), I would grant the motion now before
    us. Allowing intervention would not unduly prejudice the
    parties, but the denial of intervention may cause irrepara-
    ble harm to the movant.
    This case concerns what two lower courts found to be a
    “coordinated campaign” by high-level federal officials to
    suppress the expression of disfavored views on social media
    platforms that now serve as the primary source of news
    about important public issues for many Americans. Mis-
    souri v. Biden, 83 F. 4th 350, 392 (CA5 2023). One of the
    alleged victims of this campaign is Robert F. Kennedy, Jr.,
    who is a candidate for President of the United States. The
    District Court found that Government officials have asked
    social media platforms to block Mr. Kennedy’s efforts to
    communicate with the public and that the platforms have
    complied. See Missouri v. Biden, ___ F. Supp. 3d ___, ___,
    2023 WL 4335270, *5, *9, *40 (WD La., July 4, 2023). Mr.
    Kennedy brought a suit similar to the one now before us,
    but his case is stuck in the District Court, which will not
    rule on his motion for a preliminary injunction until we de-
    cide this case. See Missouri v. Biden, 2023 WL 4721172, *2

    (WD La., July 24, 2023). Mr. Kennedy has therefore moved
    to intervene here to protect his rights.
    Because Mr. Kennedy’s arguments on the merits are es-
    sentially the same as respondents’, allowing intervention
    would not significantly affect petitioners’ burden with re-
    gard to that issue. But the denial of intervention is likely
    to prevent Mr. Kennedy from vindicating the rights he
    claims until the spring of 2024 and perhaps as late as June
    of that year. And by that time, several months of the Pres-
    idential campaign will have passed.
    In fact, denying intervention may prevent Mr. Kennedy
    from obtaining redress for an even longer period. In suc-
    cessfully arguing that we should stay the preliminary in-
    junction entered below, the Government contended strenu-
    ously that respondents lack standing. If the Court
    ultimately agrees with that argument and orders that this
    case be dismissed, our decision will provide little guidance
    for deciding Mr. Kennedy’s case, and Mr. Kennedy will be
    required to wait until the District Court separately assesses
    his claims.
    In addition, allowing Mr. Kennedy to intervene would en-
    sure that we can reach the First Amendment issues, not-
    withstanding the Government’s contention that respond-
    ents lack standing. Indeed, because Mr. Kennedy has been
    mentioned explicitly in communications between the Gov-
    ernment and social media platforms, he has a strong claim
    to standing, and the Government has not argued otherwise.
    Our democratic form of government is undermined if
    Government officials prevent a candidate for high office
    from communicating with voters, and such efforts are espe-
    cially dangerous when the officials engaging in such con-
    duct are answerable to a rival candidate. I would allow him
    to intervene to ensure that we can reach the merits of re-
    spondents’ claims and to preventing the irreparable loss of his
    First Amendment rights.

For one thing, those pull in very different directions, and the few who actually make it caucus and with one of the big parties, usually not being members thereof only for idiosyncratic and largely ceremonial reasons a la Angus King, Lierman fur Connectacut, Burnie, etc.

    In its half century plus history the El Pee has never elected a member of congress or come particularly close. It got one elected under a big party banner to switch towards the end of his final term very recently, but that’s not the same thing.

    The last ideologically based, multistate, multimember, multi-year turd potty to elect a member of congress under its own banner was how many decades ago? The last one to elect several was when? How many orders of magnitude smaller was the federal government budget and the combined campaign budget of all congressional elections campaigns back in those times? What were the primary campaign modes and communication media?

    Before you start fantasizing about electing “several” members of congress: try consistently electing several dozen state representatives consistently every time , in multiple states, including at least some medium population and above states, under your own party banner, and reelecting some of those who win; having a respectable number of partisan sheriffs and county executive positions elected and reelected under your banner in multiple states simultaneously, particularly in median and above population counties; controlling majorities repeatedly in multiple states on city and county councils, including some of median and up quintile population, and not as a fluke.

    Things like that. When you do them consistently for a decade or two, might open up that possibility as more than mere rhetorical conjecture. By then, even control of congress, congress itself, the human species, or multicellular carbon based life on this planet may or may not exist.
