On January 26, Congressman Dean Phillips asked the Wisconsin Supreme Court to put him on the Democratic presidential primary ballot. So far, only Joe Biden is on the ballot. Florida used to have a similar commission to select candidates for presidential primaries. The 11th Circuit ruled it unconstitutional and we now have the political parties themselves select candidates. Duke v. Smith, 13 F.3d 388, 391 (11th Cir.), writ denied, 513 U.S. 867 (1994).
It should mean that the state of Florida has no further role in selecting candidates but nope, they can still reject to place candidates from the list. (My lawsuit is testing this).
I hope Phillips gets this law ruled unconstitutional, too.
Both the Democrats and Republicans are locking people out their primaries. Technically, IMO they have to right to do so, but it’s not very good for the political health of those parties. It’s definitely time for new parties.
Be interesting to see a head-to-head election battle with Biden.
