Ohio Secretary of State Says Biden Won’t Be on Ballot Unless Law is Changed

On April 15, Ohio Secretary of State Frank LaRose rejected the idea of letting the Democratic Party make a provisional filing for President Biden to be on the ballot. His letter says the Ohio law doesn’t allow for such a thing. There is apparently still no bill in the Ohio legislature to change the deadline to a later date. See this story.

  1. Does Ohio have sore loser laws? If not, Biden could do an independent candidate petition?

  2. There is zero chance that Biden will not be on the Ohio ballot. If the legislature won’t change the deadline he would win a lawsuit against the early August deadline. But, yes, Ohio allows and counts presidential write-ins for candidates who file a declaration of write-in candidacy.

    Sore loser laws have nothing to do with this matter.

  4. You’re assuming facts not in evidence (final outcome of lawsuit). The Supreme Court could choose to be partisan, or just refuse to take the case. So, sore loser laws might have something to do with it, since at least some states have thrown at least some sore loser presidential candidates off the ballot in recent elections despite prior precedents.

  6. Do sore loser laws typically specify that a candidate has to lose a party’s primary and then accept another party’s nomination or run as an independent to be a sore loser? What if that candidate won a party’s primary but then decided to run under a different party or as an independent?

They will move a lawyer off prosecuting Trump to support Bidens ballot access effort. Trump is going to be found guilty anyhow. No need for all those attorney’s on Trumps case.

  9. A lawsuit against the early August Ohio deadline would not need to have any involvement with the US Supreme Court. Early deadlines have been struck down in 30 states on behalf of minor party and independent candidates. It is not even controversial.

  21. Isn’t this kind of outcome the exact thing that the Republican Party was arguing in front of the Supreme Court needed to prevented from happening over Colorado’s interpretation of section 3 of the 14th amendment?

  22. I don’t think it is, actually. One of the specific arguments from Republicans in that case was that it was undesirable for A.) Supporters not to be able to vote for their candidate of choice. and B.) That it was an undesirable outcome for candidates to appear on some state’s ballots and not on others. So it seems to me that isn’t “totally different” at all. It’s just another example in a parade of examples of hypocrisy from the two major parties.
